I made a downpayment for a Loan Modification with ASC, then nothing

January 09, 2008

I was pre-approved for a loan modification plan and they advice us not to make payments until February of 2008, I have not heard anything and I paid my down payment in October, sent all the paper work as needed. I called in they advised me my loan modification is still in review. Can you please help us out maybe if you help we can get an answer really quick. I am not trying to loose my home I can afford the payments its just the past due and business was slow, things are picking up now and I just need somebody to help us out with this loan modification.

I did the same you did, back in nov i made a down payment, then they told me they still reviewing but wont take any payments....it's just nerve wrecking.... all these waiting and they won't say yay or nay or even take any payments now...I feel like they are counting down the clock to foreclosure.

Another in question. I have had numerous issues dealing with ASC.Like all the others my issues are the same. Is this a reliable company or should I take my money and run?

I also was pre-approved for a loan
modification at the end of October
2007. It is now the end of January
and nothing. I called to find out
what was the hold up, and they just
stated that they were running behind. I am getting nervous now.
I'm afraid they are setting me up.
What am I to do? Also I continue to get the calls from them to "collect a debt" and they are not very nice.

I am having the same problem. Applied in October 2007 and every time i call they say the same thing that they are still reviewing it. But they are refusing my payments and now my credit is messed up.

I was told I was able to be part of the Rate freeze from the President. ASC now says I am not able to get that because I am in their rate adjustment plan. My wife and I have spoke to numerous customer service reps since Dec and each one gives us a different answer. I am now looking in to getting a lawyer to make ASC get their act together.

I also was told i was eligible for Loan Modification. THis was in Nov of 07. I was told upon accepting to be under review for Loan Modification i was able to make payments as i wanted,but was not necessary. I have been making payments. Although , the last payment i made was not applied to my account. Upon speaking with one of the many customer service reps i was told i couldn't make payments i stated to the rep that i was told i was allowed to, she then applied my payment. Unfortunately, i just received an acceleration letter. Why, i dont know? If im in review for loan modification! This company is very unprofessional. My advice i keep a call log with the date and time and who i spoke with and what was discussed. I have never received my financial report to review myself to make sure they have all my correct info prior to loan modification review. I keep requesting it and again i still have not received it. It is now Feb. Anyone have any advice?

I am not sure what should i do at this point after reading all these postings. I have 3 mortgages with them. All investment properties. I wanted to discuss a plan with them because the tenant are not paying the rent and i can't afford paying the mortgage myself.
Does anyone suggest calling them and make the same trial or they will ruin my credit is i request any modifications?

I have be in loan modification and sent in a payment that they wanted and was sent back to me saying it was refused do to a brake in contract never signed one and called and had to go thur everything again. They are hard to deal with and the right hand does not talk to the left hand. Would like to get out of here, but i'm behind two payments and no one wants to help me.

I called them up and they didn't want to adjust my mortgage payment since i am in payment plan already! That doesn't make sense. i said. The payment plan is because i can't afford paying now. How should pay or follow the payment plan if i can't pay!
They said they can't help me until i finish my payment plan. Is there away i can just give them back my investment houses and have them stay away from my personal assets? Car, house, and wife's car?

I have the same problem with Wells Fargo-loan modification! They give us the run around-we are keeping track too. We are contacting attorneys today. They have not applied our payments either. That is after we fought with some of them to take them-went through phone transfers, etc. We now think it is a scam so they can tell the PMI insurance that the people were not cooperating with them and they can get the full value of our home through the PMI. They will not tell us who that is either on our loan, please help!!!

Anybody who can find a lawyer that will handle this and take them to court-please email me! We have been given the run around too long-they would not give us the PMI information either-nor give us any satisfaction in writing. They took our payments, have not applied them, yet online only shows that we are now six months past due rather than the original two! What can we do???

we too are supposedly just waiting for our modification... no one we talk to seems to know a thing.... even the person who is spouse to be in charge of the loan turning it over to the investor.... the whole point to this modification was to lessen the payment but she said it would increase...

they did the same thing to me and after 2 months they said that they had never received my down payment and placed me into foreclosure and did so aggressively that my only option was to file bankruptcy. don't believe anything they tell you and always continue to make your payments even if they tell you that you don't have to

I cannot believe what I am hearing...I have been patiently waiting for my loan modification that was approved in December. I received some documents to sign and now the ASC reps do not seem to know what I am talking about. I have been sent all the papers regarding foreclosure and how to avoid it. The rep told me to not make anymore payments that the modification was effective Feb. 1 and now I am so behind I will never catch up. I am a single mom that worked hard to get my home and now I am going to lose everything because of this incompetent company!

well we have been waiting for over 110 days for our modification.I call last friday and they tell me that it is with the person handling my acct as of the 7th. to just wait untill i recieve a call or papers in the mail. The next night i get on here and read all these horror stories so the next morning i call back and the lady tells me i can call my negotiator and gives me a number and tells me i can talk to a rep in that dept...I didn't want to bug them but I was getting nervous so I called...low and behold a lady answers and tell me that there is no news yet...then she says wait I see here that they are going to approve you for a modification and i am elated...she says i need to make a three payments and then i will be reviewed for a modification I said what you mean to tell me I have a payment due as good faith in two weeks and then 2 more and then the end of july they will review me again for modification I say i have been on this web site and seen the complaints on the run around ppl have been given and she tells me there is no guarantee and that we may have to come up with a lump sum as well and I tell her I though that was the payments I was going to be making. I said then what if I had never called this morning I would not have know I need to make a payment in two weeks. she said no she was setting it up today and i said what about my negotiator and what about the modification she told me that would have been what she would have offered anyway. I said what about my second loan and she said that they would try to modify it right away and if i got a letter dening me not to be alarmed that they would look for other options and she told me that about my first...she also told me my modification goes off of my current interest rate and I said that in oct it would be changing so now i am getting the picture they are going to set it back untill my interest rate goes up....wtf?????????? Ro

Does anyone know of a class action suite against this company? My bf is going through this same thing, its a nightmare! Im in the process of buying the house so we can keep it and be done with this company, not to mention not get killed in payments! I hate to just let them off the hook, somthing needs to be done before they keep doing this to other people. It seem like the more equity you have in your home, the more they screw with you.... WTF it right!

I too am having issues with ASC. We signed modification papers in October 2007 and made ontime payments for 4 months then had to wait for the modification to be approved... well I found out today April 16 that it was denied... what did I just get done with? NOW WHAT?

The only thing I know for sure is that it is out of there hands it is the investors decision and I know they go off your income as the interest rate also I know if your home is worth more than you owe they may opt to forclose and the payments that you make are just a good faith payment and then they take it back to the investors. I have learned this so far....I keep investigating all of it...ppl should not just complain but tell all that is going on good and bad so ppl that are in limbo can tell what they are up to that is the biggest bummer is that they cannot say for sure because I think they don't know what the investors are gonna due ultimately,,,ro

Me and Husband did a modification loan with ASC on May of 2007, but we payed very much money before it was approved,
We did get behind they wanted to foreclosure, I did explain to them as to why we got behind but they could careless and they even told us to get the money from friends or family, anyways when we started the modification they told us we had to sent so much to start it so we sent in about $1100 and they started the processes and we were still sending a big amount after that up until Nov.07-March08 we have been paying $960 until they were done with the modification and I had to call them every 2weeks to check the status of the modification and finally we got the modification papers on April 6,08 It did not make sence, it stated for us to pay $769 this month and nothing for May but starting in June 08 it would be $915 a month from now until the loan is finish being payed off, me and my husband were like what?? Some can afford that but not all and I just think that is to high,so I have been trying to get of hold on the person in charge of our modification and guest what The Guy Keith Kelly does not have a direct line he can only be reached by e-mail,the REP. from ASC tells me he will for sure call you back within 48 hours,still till this day I have not received a phone call from him yet but ASC keeps calling us to see if I have sent in the modification papers, I told them I refuse to sign anything until someone calls me back regrading this modification but I did tell them I will still send in the payment as it says on the modification papers but I will not mail it back until I talk to this Keith Kelly who does not have a phone. Should I send in the Payment or not? There so much more shit to say about ASC but I would never finsh. GOOD LUCK TO EVERYONE WHO IS GOING THROUGH THE SAME THING AS US!!

We called ASC in Jan 08 when we found out our ARM was going to adjust, we were told there was no department set up to handle any freeze questions and that until Pres. Bush finished it they were not able to anything?? Then we called back in April spoke with some one who said they had a dept. set up since July 07 and didnt know why someone told us they didnt?? Total scam #1 -Then when asked why my mortgage didnt qualify for the freeze-she couldnt tell me and wanted to push me into a loan modification- I wanted to know why since I knew we qualified for the freeze- she put a superviser on who said it was because we ha 78% equity in our home instead of the 85% required by Bush. Guess Who determined the market value of our home? surprise , it was ASC so of course we were not going to qualify!! it is the fox guarding the hen house!! they are going to make sure you dont qualify and then push you into their modification plans which as I see from above are a joke!! If anyone knows how we can fight them on this please let me know-they are PREDATORS!

I work for ASC, if anyone has any questions, I can tell you anything that is loan specific. If you are waiting on a modification, don't hold your breath. There are hundreds of thousands of the same requests and the negotiators are extremely behind. Don't hesitate to call for updates and to make sure things are being done. If you have been waiting a very long time and don't feel things are being done, ask the representative to email the negotiator for a callback. Leaving voicemails will do you no good, they hardly ever check their voicemail. If you need a modification because of an increase of your ARM loan, call 866-398-7569 and get set up with the ART team. They will review your loan for a modification and it's a lot quicker than a regular modification with loss mitigation. Although this is the company I work for, I do want to say it is imparative that you call for status updates. I've seen time and time again where a borrowers file has not even been LOOKED at and been under review for up to 6 months. A tip to remember, is that if you've updated finances (which is required for a modification), you CANNOT have a deficit. It is an automatic denial. You may only have a deficit if it is a direct result of an increase of your mortgage payment, therefore can only be up to the amount of the increase. If you have ANY type of surplus AFTER an increase, it is also an automatic denial. So as some of you may be saying, it's BS and I totally agree, but thought I could possibly help some people qualify and maybe give ASC a kick in the butt as they've done so many. Another thing is, if you've read this and think you may have submitted info that may result in a denial, RE-SUBMIT it. Even if your loan is under review, it's never too late unless a decision has been made. Keep in mind that a pre qualification for a loan modification means ABSOLUTELY NOTHING, it simply puts your loan under review, which means it may take three months to even be looked at, and if you have the deficit I mentioned, it will be automatically denied. Even if it "pre qualified" or has been under review for such a long time. It's the first thing that the negotiators look at, and is an easy way to decrease the work load by denying it right away for that reason. The last thing I want to say, is although the company may be horrible, asc DOES NOT make the decision on modifying the loans. The requests are submitted to the investors, and they make the final decision. Whether your file makes it to the investor all depends on your finances that you've provided and whether or not you've faxed your proof of income.

I hate what my company does to some people, but in the companies defense, it's done wonderful things to help people too! The hardest part is getting past the ignorant workers they have answering the phones.

I have no problem answering questions for people if it will help, and will check the site from time to time to do so. Obviously since bashing the company and giving out info that we are not supposed to, I need to remain unknown....

My wife and I went through this same ordeal with these people starting last June. We fell behind and I had 2 of the payments in my pocket but our bill for the current month had been sent out so the rep said you owe for 3 months so your note will be accelerated. I told her I can send you two payments now and the third in two weeks when I get paid. She said because of acceleration they had to have it all at once. They recommended loan mod. Said that was our only option to stay out of foreclosure. They said we needed to send in a processing fee of around $590.00, we did. They sent paperwork to us that had to be filled out and sent back along with this payment. About nine days later we receive the paperwork in the mail. My wife calls me crying at work and tells me we have two days to get it back to them. I call after work, sure enough we have two days. I ask them how in the hell it took nine days to get here as it was delivered by Fedex, they have no answer and don't care. Tried to overnight it cuz they said I could not fax it. They had to have original docs signed. Found out that overnighting does no good. We were denied for not returning the paperwork by the due date. We were told we still had plenty of time to reapply. We pay the fee again, get the paperwork back, then my wife is told not to send in payments, they will be held in a state of "limbo" and won't be processed during the mod period. This doesn't sound right I tell her so I call and am told the same thing. A few weeks later we get a letter about a special forebearance repayment plan that is part of the process. The letter states over the next three months we have to send in a payment that is equal to the original payment or less, but we get a bill for the first payment and it is almost $150.00 more. Now our due date is no longer the first but the 23 of the month. It cannot be one day late. We make the first payment on time. My wife calls them because the next payment will be due 2 days prior to my paydate. I get paid every two weeks and the check following the first payment had to pay all the utilities and everything else. They tell us borrow the money. I tell them I dont know anyone that has almost $700 sitting around at any given time that they can just loan me. They don't care. Like I said this all started in June. We kept jumping through hoops for these assholes trying to do whatever they asked sending in this and that. Finally in the 2nd week of nov. I get pissed cuz they have no answer on the loan mod. I ask why not, they tell me that they have no record of my income info. even though I have sent this shit to them twice since this all started in June. This is a day from payday so I say alright, I get paid in one day can I fax you a copy of my paystub. Sure they say. I do, they say call back in about a week and we should be able to tell you something. I call back they cant tell me anything, it's still under review. The very next day we get a letter saying we were denied. Denied because after they played the numbers game based on the paystub I sent in, remember, this was just one paystub for this month, based on my paystub my monthly income is not high enough to be able to make the payments. I call them and ask them why, they say well according to your paystub you dont make enough. Im like hang on here, half of my pay is based on commission. I don't have a paycheck that is set in stone. How can you base this decision from only half a months paystubs and my pay is partial commission at that. The decision is final. This is bullshit, I get the last three months worth of paystubs together and according to those I make on average 2-300 a month more than what they figured I would need to make to qualify. I call back the next day and talk to a supervisor and explain that the decision was based of one stub and all that but I have three months worth that I can fax in to prove I make enough. His response shocked me, enraged me, and confused me all at the same time. He says, "the decision is final. It won't do any good to fax in paystubs because as of the first of nov. we got a new director that did away with having to show proof of income. We don't require pay information anymore." I sat there for a second, trying to figure out if this guy is f@#king with me. I say, so you dont require people to send in copies of paystubs anymore and this started at the beginning of the month? He says "Yes." O.k, how in the f@#k can you send me a letter on the 23 of nov. stating we are denied because I dont make enough based on my current paystub, when you did away with needing this information all together over three weeks ago. Cant answer that one. Hangs up on me. I fight and argue and it just goes on with these people. Some of you mentioned getting different answers to the same question. We went through this so one day my wife and I were trying to sort through all this and what had happened and how we were going to get out of this. She says I'm calling them to find out why we were denied if they don't require that anymore. Between her and myself, over a period of three hours, we called six times, asked the same question, all six times got a completely different answer, talked about payment arrangements each time, the account never reflected being noted about that, now we find out this whole time we were told not to send in payments because they would not be processed, they were reporting to the credit bureau that we weren't making payments, screwing our credit all to hell, attaching all kinds of late fees and other charges, and I'm like you goddamn people told not only my wife but me also not to send them in. We were doing what you told us to do. The reply, and in a tone as if she felt like calling me a liar and accusing me of making this up, "Sir, I don't know what you are talking about, we would never tell anyone not to send their payments in. You must have misconstrued the information you were told, because we would not do that." No, I didn't misconstrue, misunderstand, or misinterpret what was said to me, I am not a goddamn idiot, I was told not to send them in, they would not be processed while going through the loan mod. procedure. The end of the conversation was a little like I was wrong, they were right, they never said that to me or my wife, and that was that. Fine send me a statement of everything I owe to bring it current, all the bullshit late fees that are now tacked on from "not making our payments," and any other charges. February 18th I get this statement. To bring the loan current, including all late fees, back payments, other fees that I still have no Idea what the hell they are for, and also including the current payment for march that is due the 1st., the grand total due march 1st, to be all caught up is 4028.00 and some odd cents. Two days before we received a letter, very similar, to bring it current send in this amount by feb 20, (3000 and some odd dollar amount) after the 20th the figure was higher. Keep in mind this says to bring it completely current, including all late fees and blah blah blah. The letters are extremely close figure wise aside one includes marches payment also. Anyway the day they printed out the feb 18 statement to send to us ( the one including march in the total-4028.00,) my wife that very afternoon western unions them 3600.00. That leaves a balance of 428.00, which when paid should take our loan through march and be all current. A week or so later we get a letter. The day we sent the 3600 in, it was reflected on the feb 18 statement that we sent them that 3600. So a week later we get this letter that I mentioned. You owe basically 1700.00 for the months of feb and march. Your loan is seriously delinquent and could go into foreclosure if not payed. I call, what the hell I just sent you people 3600 dollars, I have two different letters, one an actual billing statement that said we owed basically 4000, I gave you 3600 of that, I still owe around 400 and when I give that to you our loan is current through march, and after 45 minutes on the phone and them pulling up the feb billing statement and looking at that, seeing the money we sent, she says yeah, we made and error, disregard that statement and we will correct it and send you a new one. Never happened, I called again asking why it wasn't corrected, I explain the whole sit. the bill of the total i asked for the 2 letters they sent that basically coincided with each other, the amount we sent in that they also showed as receiving, The tell me now that the feb 18 statement that the lady i had spoken to a few weeks earlier about and she was able to pull it up, now no longer exists, they show no record of that billing statement. They proceed to say the 3600 had to cover months as far back as april, I ask when I ask for the amount we owe to bring our account current including fees and all the bullshit I assume the statement you send with the figure on it is the total that I owe to bring my loan current because that is what i asked specifically for! I get to separate mailings from you regarding the total owed, one a letter that is to bring it current as of feb 20, the other to be current including the payment due march 1. Now your trying to say that that statement is wrong and I should disregard what it says even though you just also told me that there was no record of it and it doesn't exist. She starts telling me I'm gonna break it down month by month and you follow me so you can see how you still owe this much. The first two months covered april, and -no wait a minute, the first two months did not cover april and because all of this started in the end of june/beginning of july when we owed two payments. No no, finally I said you know what I don't give a shit about april may or whatever other bullshit your going to try and confuse me with because in feb i asked for the total, this is what you sent, I sent in money based off of this. If I owed for april and these other months when i asked for the total to bring it current they should've/would've been included in the total, doesn't that make sense. She kept beating around the bush for ten minutes still trying to confuse me with all kinds of numbers here and amounts there. I ask her how the hell can you sit here and tell me that a letter that was accessible by you people a few weeks ago now does not exist, there's no record of it, even though I'm staring at it now, but it doesn't matter because it's wrong. Billing statements are not necessarily correct she says. So I say fine, the billing statement that you sent saying I still owe for feb and march is wrong also and I am not paying that amount. No, that statement is correct. I ask her prove it, prove to me that its right when the one that i have that I was told once already is right, you are sure its wrong even though it is supposedly fictional according to you, Anyway this is starting to get confusing, she never was able to answer that question, by the way, when you apply for loan mod. the paperwork says if you get denied the processing fee you pay gets applied to your outstanding balance or it is refunded to you. I asked her about that, we paid the fee twice, not once getting a statement showing it being applied to our balance and they were never refunded. I asked "where are those payments? What ever happened to them?" All of a sudden she could not access that information, then the entire computer system went down and I would have to call back. I still have not got it straightened out. I see posts from some of their employees assuming we are all just irresponsible people trying to get out of paying our debts. Those people can fuck off because they dont know their heads from their asses to begin with. These reps you talk to and they tell you to do this, its your only option. I was told these people tell you what they believe in their own opinion is best for you regarding you loan, and how to bounce back from falling behind, the whole time the decision you make concerning this affects more than just yourself but the welfare of the family you may be supporting also, like a wife and two young children. I don't know what there training is, but it seemed to me that these reps you talk to, that advise you of your "best option", that can never give the same answer to the same question, seem to be nothing more than fucking telemarketer types that have no real knowledge of mortgages, banking, and half the time how their own damn system works, and furthermore they sure as hell should not be telling people who call needing help what their "best" option is especially when a wrong decision made off of their advisement could seriously hurt the welfare of someones family that is just trying to do what is right for their families.

I had the same problem. However, they told me that my paperwork was in the mail. After a month, I called them back and was told that my paperwork had been sent out a month before. I was also told that I did not owe any money because I had paid the down payment to modify my loan. I received a packet from DHL with my information and was told to send in payment within 1 week. $3500. I called them and told them I didn't have that much money and that I had made several phone calls and was told that I owed nothing. I also asked why I had just received my packet. I was informed that they had no control over the mail. That was not their problem. I am still trying to recuperate from having to come up with that much money on such short notice

We are moving out of our home... we are sick of the fight and the struggle. Everything I have read is all to familiar. Sad to say it is not funny, but this company is a wreck. I too waited to hear back about a loan modification. 87 days later I get a DHL envelope giving me 4 business days to pay them $2k which I have but the agreement was a forbearance not a loan modification. They advised me to pay a down of $2k and for three months $2100 then a whopping $15k. when I called Wells Fargo and ASC they both advised me that once I made my third payment they would modify my $15k into the 27 years I have left. Why I asked was it not in writing. We dont do that they said. The agreement stated that I agreed to these terms and dates, but I refused to sign and now their probably accelerating my foreclosure I dont know. I advised them cant do the $15k they said dont worry we dont expect you to but refused to annotate or send a correction of agreement. tehy wanted me to TRUST them. good luck everyone.

Well we are waiting for a forbearance we send in 2700.dollars for 6 months then they sent us a letter state that we has to do a loan modification.They need us to sent in 1500.00 and the will approved the loan modification.wait 2 months no answer.Om March 27;2008 will receive a letter state that the loan modification has been approve. but the need 1956.00 by may 12008. and our house payments increase by 500.00 dollars.I NEED a GOOD LAWYERS please help

Oh my god I cannot believe all these comments. We were told last October to send in all our paperwork for a loan modification. When we did not hear for a couple of weeks we called back only to be told that they had never received the paperwork!! Twice more, we sent the same paperwork, by mail and by fax. Ok - so we think we have to sit and wait for a short time (yeah right). We called them numerous times - each time them telling us never to make a payment as that would void the modification process. We cannot even remember now how much money we sent them to allow the loan to be modified - about $2,600 I think. Anyway the weeks go past, no repy - just daily recorded phone calls from them. More phone calls - nothing. As I only have Mondays off work I would always call on a Monday - eventually I was so mad that I had heard nothing I demanded to get an answer right there and then - I don't know if this was a good move or not as I was then told that the person who was handling my modification would be away from the office for another three weeks. Forget that - I demanded to speak to someone who knew what they were talking about. Not really any joy there except to be told that I should hear shortly and still not to make any payments (as if by now there was any way that I could come up with the $27,000 that they were asking for). Anyway within 2 days after waiting all this time and not getting any help or answers and my credit going down the toilet - was told I had been denied. One week later we received the formal Notice to foreclose - . We immediately put the property up for short sale - (our house is worth at least $200,000 less than what we paid for it). We have had two offers and or course now we have to wait for ASC again!!

I hate this company with a vengeance - they have totally wrecked my life!

Same as above, i started to work with the ART Team since October 2007 before my payment incresead in January 2008, I called almost every day and received a different answer. I have decided to stop makeing payments, (payment increased $1,000) Still waiting for a response from the negotiator just spoke with one last friday and asked me to submit my financial information once more for the last three months.

I wish I had CHASE, i've heard of them modifying their loans as low to a 5% on both the 1st and the 2nd.

it seems pretty clear that no one is going to save us. we have a choice to complain or to fight. then we have different ways we can fight. it is an old and tired but true saying that there is strength in numbers and that where two or more are gathered together . . .for the justice, we can slay goliath. I see ASC as goliath. they ARE predators, whether they are THE predators or just the REPRESENTATIVES, it is ONE and THE same; there is no difference. THe fact is they have their HANDS in the till and are benefiting off of OUR misery. They may have helped a few people but for the countless thousands they have harmed it is hardly worth mentioning. Those of you who are still able to fight, we need to get organized and stop believing that we are going to be rescued; NO ONE CARES. Unfortunately we live in a capitalistic society where the bottom line is the almighty dollar. Now as far as what we can do?? We need people to volunteer for positions that represent their strength, so if you are an attorney, or paralegal, writer, etc. then you can help to do the writing, if you are a great public relations person, then you can help to get the word out. I am thinking that we need to get an accounting of how many people are damaged by ASC and then we need to expose them and their practices as fraudulently pretending to want to help when in fact they do not, where other companies such as Chase are working with their clients, ASC is trying to bury theirs.

We can put together a website, blog, press releases, etc. WE CAN DO this, But, we have to have at least a few GOOD MEN and GOOD WOMEN who are ACTIVISTs and as the man said in the movie, Tired as hell and not willing to take it anymore. Let's fight back!!

If this is not terrorism what is? The fear of those who would destroy us was wrongly placed on people who have not done anything to us here; but the real terror comes when you are in the predicament we find ourselves here with ASC.

Who are these investors? ARe they from another country? Probably. Are they here to carry out their plans of forcing Americans out of their homes? Probably.

Why cant we send a flood of letters to our senators, newspapers, 60 minutes, etc. and demand that an investigation be performed on the methods ASC uses as opposed to other lenders/investors? My ARM went up to nearly 11%.

The new terrorist is in our midst, but invisible, anonymous, cloaked in mystery.

I applied for a loan modification sometime in October 2007 or November 2007. I contacted ASC several times between Nov.2007 and Feb. 2007 almost every day. I was very frustrated and tired of their customer service representatives providing different answers. I emailed the Wells Fargo's Board of Directors on 02/14/07 complaining about ASC loan modification process. In my case, I have a pretty good credit and have not missed any payments. The increase in interest rate would most likely result in a foreclosure. I received a response after 2 weeks from an executive assistant, Michael Harrison. He gave me the modification rates right away. I received a reduction of 6% on my first loan for a 30 yr. fixed then my second loan stayed at 8.25%. They are both fix rates with P&I. I received a letter from Mr. Harrison within the next week. The mortgage payment is still high for my income though so I'm struggling.

Ohkay........I, as well, am thinking about loan modification to refrain from forclosing. After reading all of these comments/questions I am now realllly concerned. I work two jobs to pay my mortage and get by. I can't do this forever. Does anyone have advice, a different way to aviod foreclosing. ASC seems to not help at all!

OK, I posted a while back and got the complete runaround from ASC. One day I would call and they would say things were fine and the next day no one knew what I was talking about. I was also told to not make any payments. However, I did get my modification. I never received a statement or anything until recently. I was able to find out with the website mortgageaccountonline my new rate and payment amount and just mailed it in. After that I began to receive statements. My rate is much lower and now my mortgage is principle and interest instead of interest only. It was sooo stressful but i got to keep my house so it was worth it.

None of this is worth the stress... if you are working two jobs to pay for a mortgage that went up... that is not healthy. God knows who is at fault here. ASC is not willing to work with some people and that is just sad. Don't let it kill you. It is just a house.... we finally let go and walked away. We are much happier now and realize the next few years will be tough, but honestly, it was what it was... trying to make a $2700/ month housepayment on a $250000 home worth $235000 is just not worth the stress. We will bounce back and each and everyone of you will too. I am not saying ASC is to blame, we just did not know what we got ourselves into and honestly... ASC is guilty too for not even trying to help... such is life. You pick up the pieces and move on. You can't change the past and do a redo.
To all of you who ASC is working with.... you are part of the lucky ones. To those of you who are not finding help and hope... Just PRAY for direction. God brings things in strange packages. Don't let it run your life. Like I said, it is only a house... you and your family is what makes it a HOME. No one can and not even ASC can take that away!!!!!!!

I actually ask my Mortgage company for a loan modification , and it was free. they also lowered our rate.. Its in there benefit for us to keep our house and make payments....they loose money if we go into forclosure..

I have been trying since November of 2007 to modify my loan with ASC. They increased my interest rate from 7.75% to 10%. I made my original house payments on time for the two year fixed period and now that they've increased my payment by $800.00, I can't afford it. I have 3 small children and don't want to move, but ASC has denied my request for help 4 times. Why can't they just freeze the rate and payment? It's not like the original rate was low, at 7.75%, they're still making money. Now they're asking me to make 3 consecutive payments and then they'll consider a modification. Why would I give them a dime, when they've denied me 4 times before, what's going to change their minds? After reading the blogs from others about ASC, they can have my house back. I owe $376,000.00 and the house is worth about $225,000.00. Good luck ASC recovering the money. You should have let me continue to pay the original rate and payment for my house rather than be greedy. As long as it doesn't cost me any out of pocket expense, anyone sueing, I'm on board.

everyone should know by now that mortgage lenders such as ASC and all others will not WORK with the borrower; they do not take you seriously; you have to pay for another company who specializes in negotiating with them who they know knows the RE laws and TIL disclosures; Most of you are holding loan docs that have blatant TIL (truth in lending ) violations and you can USE these as LEVERAGE to force your lender to renegotiate your loans.

I have been with ASC for 2.8 years. I have made late payments and acrued a late balance of 1100.00. I never went 30 days until July. I just made my July payment in August. I received a letter saying the mortgage would be accelerated in September 16th. They needed July, August and September + the 1100 late fees and some other fees amounting to almost 8000.00. They said if I didnt pay it all by September 16th they would accelerate the mortgate.

Are they serious. I can pay most of it, but not all of it. Will they still accelerate the mortgage? Will they let me still owe the late fees? Any advice welcome. Thanks

I do know first hand this company sucks,The reicved a payment from me I wrote down a confirmation number,which by the way dose not matter and they told me I was late,I told them the dumb rep that I paid 20.00 for making my payment must have screwed up,it showed luckily in my bank that the payment was infact paid,they said i needed to fax all proof over to missing payment department,that didnt help either now it will be on my credit late but it was their fault...the rep said it wont be on your credit it will be on your husbands because the loan is in his name,well he is the soul provider and his credit is the most valuble out of the 2 of us,no they do not care about thier customers at all........

Oh my gosh, I can't believe what I am reading with all these comments.

I to have an ARM loan, and am afraid it will go up tremendously! I was told at the time that this was my only option. My mortgage is set up in two payments between 2 separate companies and 80/20 loan.

Back in late March/April of this year, we were working with a mortgage broker, who helped us get our first mortgage so we trusted him, who was in the process of refinancing our loan (at least that is what he told us and that is what we signed) He told us that any back taxes/insurance or fees that we owed to ASC and our other company would be included in the re-finace so there was no need to pay. So we used the money to take care of other various necessites. After him telling us and e-mailing us that we would be closing within a few weeks we did not hear from him any more. We tried to contact him by every number we had and e-mail but got no response. I guess We got totally screwed but it doesn't stop there...

We were getting ready to ask for a loan re-modification because my husband is in need of a kidney transplant and due to all the adjustments we have had to make in our lives we were falling behind on our mortgage even more. We had never been late on our mortgage loan for almost 2 yrs and when we got a little behind ASC told us if we sent in a lump sum of money to catch up they would take off any late fees or other fees associated with this. Well, we did just what they said and when we called to see why the late fees had not been taken off we got the same run around that all of you have gotten. Now because of this it appears that we are more behind on our payments and we continue to recieve harrasing phone calls and threating letters about our home could go into forclosure.

I am not sure what to do at this point! all these comments have scared me. I don't have money to hire a lawyer, I don't want to loose my home especially with the condition my husband is in and plus I have 3 small children. Are there any options for me because I get all these calls from companies who say they can re-finace my mortgage and we end up getting the run around. I am willing to pay what I owe to ASC but how can you catch up when we all are having the same similar problems with this company. I am scared to give them any more of my money at this point. I did not ask to be associated with ASC, but after about 4 months of purchasing my home my loan was sold to them!

Many people have told me to file bankcruptcy, because ASC is helping to make my credit worse every month. I don't want to loose my home that We have worked so hard to get!

I too was waiting forever for my loan to be modified. After 6 monthes I still had no luck. Then my niece told me of a company that got her and her friends modified. Stephanie my nieces friend told me she has ASC and I started screaming because this payment was really killing me and my family. She said it took 60 days and they charged a upfront fee. I was skeptical but figured what do I have to lose.
After 60 days Jay over at www.proloanmods.com had it done 5.5 % fixed when I was just over 10% adjusting. I told Jay I'd be giving out his direct number and he said it was ok. if he doesnt answer just leave a message he was always very prompt with me. I hope this helps you guys

We have been waiting for saxon mortgage co. to do a loan modification since March now. Each time we call we get a different person. They said not to make payments but hold onto most of the money because we would be asked for a down payment./ No one could tell us what the down payment would be. we have other bills to pay and cannot save a whole lot and just sit and wait for this company to make up there mind. We have talked to a lawyer about bankrupcy but on a chapter 7 we would loose the house. we are considering a chapter 13 and then we could keep our home. does anyone out there have another answer. thank you

I have my house on the market for the past 9 months. Several offerts were considered with no luck from ASC. Like everybody else, they give my realtor, the buyers and us the run around. I lost my job for 4 month and could not pay my house. I have never seeing such an unprofessional treatment to client as ASC had given to us. The fact that they have their money secured with the PMI's is true. They do asked the insurance company for the payment and then you have to pay the insurance the rest of the money that they did not recovered. I wish for everybody to get together for the biggest Lawsuit in history.

We are going through our own mortgage comp. We were approved and everything is in writing. So far so good. I would first suggest trying to do it on your own. I was to scared to trust these companies so we went on our own. It seemed like I never heard of a person who had success. Everytime you hear of a person with a great story it turns out they work for the company. It was one of those things my Dad always said. If its to good to be true then it probably isnt but when your in trouble you just want to trust someone who says they can help. I can't believe this happening and these companies are getting away with it. The big question out there does anybody know a good honest company.

ASC is an absolute nightmare. I have not dealt with them for <a href="http://www.shortsaleway.com/loan-modification.html">loan modifications</a> but I have done short sales with them. I have never had a good experience.

I understand that ASC should work with people to work out changes to their loan, but they do not have to. You took out the loan and signed the contract that stated what the rates would be and you knew what you were getting into. You can not blame the bank for a contract that you made with them and you want to change. I think it would be in their best interest to do so, and it sounds as if the company is totally messed up as far as setting up the system. Take reasonability for the loan that you took out and stop blaming other people for you rates going up, you knew it when you signed the closing papers!!! This is part of the reason we are in the mess we are in. People not owning up to what they said they would do and blaming others. It was great when prices were going up but now they are falling and it everyone else’s fault?

10-24-08 several days ago I contacted ASC to ask about modification process, as my 5yr ARM is adjusting aug. 09. the rep said I would not be able to apply until June, 2mos before my rate was to begin adjusting. She also said that under the presidents rate freeze that my new rate if approved would be exactly what it is now, 4.25%. I asked her if I could get a copy of the program requirements for review and she said that there were no such documents, that the application would be taken over the phone. sounds a little too good to be true, more like a setup for failure.

I agree that anyone clearly knowing what they were getting into should accept responsibility for whatever their payments goes too. However, if you truly believe there is always full transparency by the lender you are being naive. When investors and lenders are losing money because of the high interest rates it makes sense to put them down to a level that is equal to market rate(no better then other borrowers that can afford and are paying their mortgage on time) When a borrower demonstrates a willingness and ability to pay at market rate , why not do this over a foreclosure? You really think all borrower should be forced into an interest rate of 8-13% for thirty years after proving an ability to pay on time?? When fairness and common sense is not used, this is when tax payers are forced to pay for the lender and investors greed and speculation. The investor liked the returns, how about accepting some of the risk? (sub-prime lending has made a lot of people money)I have always laughed when you consider that the population that has had history of credit problems, limited income, job instability are the ones that are charged the highest rates and the most fees. These rates did not offset the risk, they are what are causing the loss.

Got denied twice from ASC for the loan mod. Once for a monthly surplus in income, once for a deficit. They lost our paperwork three times. Finally wrote to the Board of Directors at Wells Fargo and got immediate results. Was contacted within two weeks by the Executive Communications Dept. and had a 30 year fixed rate at 6% within a month. Bottom line is: you've got to make enough to afford a new rate, and you have to speak to someone other than the low level employees.

I think ASC is a bull shitty ass company. Thanks to them ass holes I may be loosing my home. You call and can never get a straight answer. I did the special forebarance bull they have, I paid 3400. to get my loan back on track, then for the next 3 mos it would be 900 and some change well I paid twice on time and once it was late due to bank error and the bank even sent a letter explaining the mix up and they still wouldnt except my check, they returned it. I have tried to speak to them they are a constant headache. When we first decided to buy our house my husbands father told us to go with wells fargo, and I straight up told him no way no how would i ever want to deal with them because i've always heard nothing but bad about them voultures. So we got a different co to back our loan, and our loan ended up getting sold to this f'ed up company. and we ended up with them anyway. I think its just ridiculas.

i'm in the mess with asc!!!!!!!! they are the worst thing since HILTER!! I think some of us are hoping that our new Pres. will change this around for us, but i just don't know I just sent my first payment to Hilters legion of doom hoping for the best it has been 14 months since this mess has started i'm afraid the end is near after reading all of these blogs. they got first with the escrow trick thats killing us called my county tax dept. they told me everything was fine and that Hilters crew should not have done this. called the furor on this and he and the Wizard said we where wrong. then one year later to the day almost they did it again. now its starting to hurt. our credit going to the gas chamber. so its very hard to get a new mortgage from anyone. right now kinda stuck in survival mood with nazi regime. please send in the troops if possible. gas chamber is getting close.

I have already went through a loan modification. I was only short half of a payment for one months mortgage. They talked me into this loan modification like it was the next best thing. We agreed and 3 months later recieved an approval of an increase of $300 a month. This company is a nightmare. My mortgage for my first house was sold to asc & i had went into a chapter 13 prior to selling. I sold my house 5 years later. I bought the house in 1998 for 97,000 & sold it in 2006 for 168,000. ASC told us our payoff was 124,000!!!! How is that possible? How can I pay on a house for 8 years & the payoff be almost 30,000 more?? Complete scumbags! If I knew I could take them to court, I would! I hate them with every piece of what I am!! And to call customer service, what a joke! They are the most ignorant people I have ever come into contact with! Unfortunately when I bought my 2nd house a few months later I was sold right back to them bastards!! I hope thier building blows up!& why is there website so secret? You can't find that thing to save your life! And when you do it'll work for a short period & then all the sudden the page cannot be ddisplayed. I'm trying to print my end of year statement because they take their time getting it to you & its impossible. Oh & when i called on my payment that I had half of I had explaind I was hit by a drunk driver & was just trying to do my best cause I almost DIED and the rep said and I quote "looks like your best isn't good enough"!!! I recently cpompleted a loan modification with ASC. We were automatically denied twice. I asked what they were looking for. It is exactly as described above by the ASC employee. Any deficit in budget must be due to increased mortgage payment and be less than the amount of the change in monthly payment after the modification.

You will call 845 times and talk to an idiot. Keep calling as one of those calls will put you in touch with someone who knows and cares. i think I probably called 75 times after our file went to a negotiator and talked to morons who had no idea what was going on, and thus gave me bad information. All the while the loss mitigation department WAS proceeding with the modification. don't assume the person you are speaking with actually knows what is happening with your account. Keep calling until you get somewhere. Good luck.

Glad to see we are not alone dealing with asc we have had many misfortunes this last year from loss wadges to no jobs lost a infant grand-daughter on dec-15 my dad christmas eve and my husbands mother christmas day we are faceing so many crises at once ,we ask the bank to move our payments to the end of month to give us a chance to get caugth up ,they would not help us ,we have contacted them with either no responce or some one that has no idea whats going on we have called houseing help loan modifaction lawyers local lawyers (all these cost money) that we dont have.now we are in now after 13 years of payments they have filed forclosuer on us . all we have now is memories of what use to b our home. bless each of you and hope you find the help you need to deal with asc oh yeah we did talk to someone once from the bank and told them we were working with a lawyer and the responce was (a laugh and good luck with that)gee thanks asc

ASC is owned by Wells Fargo, they made over 3 million last quarter. They help no one! They do not care about the working, middle class and the stimulus package is a big joke. The banks got all this bail out money and they will not lend it our or refinance so the people can catch a small break. All they want is their high interest money and they don't care how peopl get it. Companies like this continue to get richer while those of us who work hard for a living are barely making it.
Do not even bother trying to work with ASC, find another lender. I think FHA is about the best way to go but then there is PMI that cost additional money.

I laughed and I cried with all of you. After reading each and every post, I recognized my own situation in some of them, and found it hard to believe that ASC does not want to help.

Then I thought, 'they are looking at their bottom line, not at us.' Will you be able to pay in the future? It's their money invested in you. They are not neighbors, family or friends. My loan through ASC IS actually owned by Hitler's bank. Probably yours, too.

Listen, I agree that by charging a huge rate, they are actually losing. Remember, you are not dealing with a small company and where money is concerned, they invest -- you pay. It's cut and dry. At least they're not breaking our legs.

They don't see our heartaches and the stress and pain this causes. We know what we want -- a good interest rate that won't prevent us from having the ability to pay. They want to be sure you will pay -- a guarantee.

By the grace of God I have hope and I'm grateful that the ASC employee posted. I have gone through the whole process, paid my forbearance and am now waiting for my modification.

The one who posted the words that say, "it's only a house" is right in a way. My advise, "Don't give your hope away. Keep fighting!"

Faith and hope cannot be taken from us. We give it away willingly. Be at peace, have faith... your day will come and you will survive this.

We actually want ASC to prosper but also to rethink the way they do business. Many companies have and they do better in the long run. If they don't take more than the people can give they could save lots of time and dollars.

If you're interested, I'm a documentary producer and would love to do a show on this, if we can get the funding. Anyone else out there? We need to show that we are real people with real pain and we need to do some investigating as to why some of us are going through hoops when we shouldn't have to be. It could be that they are just overwhelmed by the influx.

Recently submitted my 5th attempt at a Lo an Modification wi-th ASC. The last time they denied due to to way to much debt to income. Turns out they calculated their own loan (expense) twice. Go figure. Just received a letter stating they are reviewing my paperwork for Modification along with the 2-4 letters I receive weekly stating my loan is late and they have programs that can help me. I have already modified my second with GMAC, which only took about 4 weeks to complete. Hoping everyone here has good luck with this company but I can say this, these guys are unprofessional, rude, and non-responsive. I will keep my fingures crossed for myself and everyone else dealing with this company.

We were only one month behind on our adjustable rate payment when I tried to get them to modify our loan and all they did was give me the run-around! I couldn’t believe it when the guy on the phone (he was a big jerk!) actually said that my family shouldn’t eat so much because then we would spend less on groceries and would have more money to make our mortgage payment! He also said we should get a cheaper car and a bunch of other stuff that was really rude. This whole thing was keeping me up at night worrying about what was going to happen to us. I told my friend at work about this and she said I should call the loan modification company that got her loan modified down to 3.25% fixed interest rate! I finally decided to call them, and in about 45 days they got my interest rate down to 3.85% on a fixed rate too! The company is First American Financial Group and we are really happy with what they did for us. The website is theloanmodfacts.com. We chose them because they didn’t make a bunch of promises like some of the other companies and they had a 100% money back guarantee. I hope this helps some other people fighting with their loan company!

I tried going it alone with my mortgage company but was given the run around. I thought about a loan modification company. However, a few I looked up weren't licensed by the DRE in California and with some of the horror stories of deal with some of those companies, I decided to go with a law firm in Orange County, Ca. Thanks to Parman Law Group out of Irvine, I was able to get my principal reduced and my apr lowered also. Now I'm paying at least 1/2 of what my mortgage payment was before the modification. Kudos to Parman Law Group. They treat you like a friend and not just another client.

i have been in my home for three years i had got my loan with seria they say we had to make payments of 3011 a mon. and on the 4th mon my pay will go down before the 3th mon sold it to avelo try to get a mod they say no sold to litton on jan 2009 i recived mod paper work form titiauon send it back never hear form the in feb 2009 i call lition thats when littion said the paper work was late but just sign these forum for us and you have to go thought us for a mod call 2x every week untl july 14 th of this year when i recevie paperwork form th law i call on the 6, 9,11th the i told my mod was still been look at no answer at this time dont no about the lawyer send papers out on the 14th i cal again and was told they had said no on the 6 of the and wil not relook at it what can i do

I read these posts and I'm with ASC. I can actually afford the monthly payment but got behind because of a stupid idea of buying a restaurant. So the restaurant is gone and yet I'm behind in my payments. Long story short - I"m trying to get a loan mod. Started in May but wasn't until July that I was told that I need to update my info. They keep telling me - oh we'll let you know next week. Well since two weeks ago, I've been calling every other day and faxing my paperwork every Monday. I haven't given up hope but they want to sell my place mid August. If I don't get answer I'll just do chpt 13 and the house will still be mine. HOpe the economy will improve but at least I'll be able to keep my place. May not be able to get any other loan because of the credit but if they won't help me - I'll help myself. What is they say "No action on your part results in action in mine".
Those that call every 15 days or once a month - no call every other day. Be nice but persistant. I'll update this post if something good happens or bad. After reading I don't have much faith but what I do have is myself. If there is a class action lawsuit - just email me I'll review it. Just stupid that there are folks on here wanting to make good and ASC just fucking around. Ah for the buck - not to get cynical but come on - you know if you help us get back on track you'll make more money from us. Yea I know go figure - help... I am trying to do a loan mod with ASC, have been for a few months now. I actually hired someone to help me out and I just called ASC and they have no record of my paperwork. I don't understand why. I have heard they do this and give me people the run around. So, instead of relying on this person I hired to help out I will just try to do it myself also. They are sending me the paperwork in the mail. I am encouraged by this website, it always helps to know others are going through the same thing. I will be persistent and keep trying.

I see I'm not alone in this battle. I have been working with ASC for almost a year trying to catch up on 2 delinquint payments. My husband and I ran into some major financial difficulties. We even wound up filing bankruptcy, chap 7. During that time we missed 2 payments in Oct and Nov of 2008. I tried calling to see if we could get some sort of extention before it even happened, but they didn't care and wouldn't help. So after missing the pmts I applied for a loan modification which took them 2 month to figure out! Like many of you they set us up on a forbearance agreement where we had to make a down pmt on both loans (we have an 80/20) and then an increased pmt for the next 3 months. I was told that after we completed the forbearance agreement they would then review us for a loan modification. We made every pmt and on time, the final pmt being in June 09.
I then had to reapply for the mod, resubmitting all the documents, pay stubs etc... We were denied due to us still being under the bankruptcy protection which was scheduled to be discharged in August. The Investor would not approve any modification because of the bk, ok I get that, they don't know what our intentions are so until the bk is discharged or they go back to the courts and request the automatic stay be lifted they weren't going to help.
We have every intention of keeping our home! About a wk later we recieved a letter informing us of a scheduled court hearing for ASC to have the automatic stay lifted so they could take action. Our discharge date was 2 wks after the date they were requesting the lift. Whatever.... they didn't want to wait. So fast forward 2 wks, I reapply for another loan modification like I was told to do once our bk was discharged. I was told that we were approved for another forbearance agreement and we had to put down a ridiculous down pmt and that our pmts would be increased by 400 for the next 3 months. Oh and I have a week to give them this down pmt, they can't do any better than that. They also are claiming that we are 3 months behind when we are only 2 months behind. I have every cancelled ck, all my bank statements and they still can't seem to figure that one out!!!
Meanwhile I found out that as of last friday they have put us into forclosure.
I am beyond frustrated and mentally exhausted, overall just tired of dealing with this company and not getting anywhere. Once I complete this forbearance agreement they can continue the forclosure process while they drag their asses for another 2 months deciding on whether or not they will approve the loan modification.
I just don't understand why a company would rather take a loss then help the homeowners who want to keep their homes.
In our case we filed chap 7 we have absolutely no obligation to this place what so ever, we could walk away free and clear. But thats not what we want, we are trying to keep it. Our loan is for roughly $35,000 more than our home is worth. I am positive they will not get what we paid for it, so they will be out alot more than we owe.
It just doesn't make any sense to me. I have no choice but to keep at it if I want to keep my house. Just hope all works out in the end. Good luck to everyone out there, I truely feel for you!!

asc and wells fargo are Bank of America pundents if you get my drift. Actually i give BOA some credit for their poor services. 1) I am delinquent on my payments 12 mos now, my loan mod started in Oct of 2008. Actually now that they are in hock with me for nearly 15,000.00, I feel like I am the one that can force them into BK ha ha. They still to this day still tell me my loan mod is under review. I am sure they are waiting to foreclose on me. I am ready to walk away. What I find incredable is: they stand to lose a lot of money. ie: Foreclosure fees, back taxes, the late fees I havent or will not pay them and the lower value of my Home(which is about several thousands of dollars. But all they have todo is offer me an affordable loan MOd with a lower interest rate and redo the principle to current property values and I am more then willing to deal......I think a lot of us are so loyal to our homes and when you reveal this to those lenders or mortgagers they got you by the balls or whatever. They then play on your silly fears and use these service people to bullshit you when you call them about your loan or your loan mod. FIRST OFF DONT PAY A SINGLE DIME TO THEM FOR NOTHING. THATS YOUR FIRST MISTAKE. THEY WILL TAKE YOUR MONEY AND STILL DENY YOU. WHOEVER SAID THE REAL TERRORIST ARE NOT THE GUYS BLOWING UP BUILDINGS, BUT THEY ARE THE GUYS RUNNING THE BANKS AND HITTING WHERE REAL DAMAGE IS DONE. THEY HIT AT THE HEART OF AMERICA, THE HOME, THE HOME THE FAMILY, THE FAMILY...THIS IS WHAT GREEDY INVESTORS ARE ABOUT...GET SOME SMART FINANCIAL EXPERTS AND MILLIONS OF AMERICANS TOGETHER AND START AN INDEPENDANT BANKING SYSTEM MANAGED BY PEOPLE WE TRUST AND CAN HOLD ACCOUNTABLE AND WE CAN BEAT THIS CURRENT DISGUSTING SYSTEM RAMMING US. We were having the exact same issues with ASC, and once I started doing some research and read all of the comments on this blog, I got really angry and decided to fight back. I wrote the following letter to my state and federal congressional representatives, and copied several Wells Fargo executives. Within 12 hours of sending this letter, I had received a call from someone at the office of the President of Wells Fargo, who gave me his name and direct phone number and fax number, stating that he would be handling our request. He overnighted me a package containing the materials that I would need for a new, more detailed application. I spent about 10 days putting our new application together, running out last night at 1:00am to fed-ex the 107 pages to him, and then got a call this morning from him saying that although he hadn't even received the paperwork yet, that he had just received a notification that the Loss Mitigation Dept. had mysteriously decided to have another look at our application, following my letter, and had approved our loan modification request. Not only are they tacking the past-due amount and fees onto the end of the loan, but they are lowering our interest rate to a fixed 5%, and we won't have to resume our payments until December. He also stated that he would have to look at the materials that I sent him, but he might be able to do even better for us! Somehow, I have a hard time believing that this was just coincidence, after the way that they have jerked us around for the last 8 months.

I would urge everyone to put up a fight! It seems that once you make it clear that you won't go down without a fight, they are perfectly willing to actually work with you! Here is a copy of the letter that I sent, in case anyone needs some ideas:

Dear Senator Wyden,

My husband and I have owned our home for eleven and a half years. However, we are currently facing foreclosure by our primary mortgage holder, America’s Servicing Company (ASC), despite the fact that we are willing and currently able to make our monthly mortgage payments. ASC has scheduled a sale date of December 21, 2009 for our home to be sold at auction, although the value of the home is currently about $100,000 less than we owe due to the deflation in housing prices. The last time we refinanced, several years ago, it was with GMAC, and was a prime loan at around 6% for a fixed 30-year term. This loan was subsequently bought by ASC.

This all started last fall when my husband and I, who are employed through our own company, ran into financial difficulties. My husband is a software engineering consultant, and had several clients who either cancelled long-term contracts unexpectedly due to financial problems of their own, or just decided not to pay us for the work that he had already completed. Currently, we have outstanding past-due accounts receivable in excess of $25,000 that we expect we will never collect and have written off. We also had several months where my husband expected to have employment and ended up unexpectedly having none when contracts were cancelled. For several months, we were forced to use credit to make our monthly mortgage and car payments, as well as for other bills, and as a result, we ended up in credit card debt close to $80,000 at one point.

We have seriously considered bankruptcy, and have been advised by a bankruptcy attorney to go ahead with it and “get a fresh start”. However, both my husband and I feel that bankruptcy is the irresponsible route, especially in the current financial state of this country, and have decided instead to attempt to work with all of our creditors to either work out long term payment plans, or settle for a lesser amount than originally owed. Currently, our credit card debt is at around $63,000, and we are paying off additional settlement payments every month. We expect to have it down to $20,000-$30,000 within a year and will continue to make these payments in the hopes of eliminating it entirely.

Beginning in January, 2009, we were unable to manage the monthly mortgage payment for several months. We began discussing our financial situation with ASC at the end of February, and were told that we “should” qualify for a loan modification in which the missed payments would be tacked on to the end of the loan and then we could continue with our regular monthly payments without further late charges or having to catch up on back payments. We submitted the necessary paperwork, and were told that while the request was being processed, our account was essentially on hold and that we shouldn’t make our mortgage payments during that time, that we had to be three months behind on loan payments in order for a loan modification to be approved.

Between March and the end of June, we submitted the loan modification paperwork 7 times. It was lost twice, rejected because we hadn’t been told that both of us needed to sign and date every page of the request, lost again, rejected because the “Loan Negotiator” didn’t know how to read a P&L statement and misread our income, lost again, and then rejected because there was a mistake on our credit report (when ASC bought our mortgage from the previous holder, GMAC, GMAC never took the mortgage off our credit report, so it is essentially listed twice).

Toward the end of May, our employment began to pick back up and we are currently pulling in enough to manage all of our bills, including large credit card payments and the mortgage payment. However, when the last request was denied in June, ASC immediately put our house into foreclosure, with past due payments of almost $25,000 due in order to stop the foreclosure proceedings. At this point, unless we have the full $25,000, they will not accept payments from us toward that total.

In July, we submitted our latest request, complete with copies of bank statements showing the increased income, a P&L statement from our company showing our income, a detailed spreadsheet listing every debt that showed up on our credit report along with the current status, amount owed, and monthly payment schedule that we had worked out with the debtor, as well as a detailed letter from us explaining the entire situation and why the previous negotiators’ denials had been mistakes. I also wrote on every page of the application a request for the negotiator to contact us so that we could explain things such as the mistake on the credit that had caused previous negotiators to deny the application.

After I faxed the application to ASC, I began calling their Loss Mitigation and Foreclosure departments every 2-3 days to ensure that nothing in our application had gone missing, that no further information was needed, etc., and each time, I attempted to get in contact with the negotiator or find out his or her name. During each call, I asked the person that I spoke with on the phone to contact the negotiator with a request that he or she please call me, giving both my home and cell phone numbers. Each time, I was told that the negotiator’s name was not listed, but that an email could be sent with my request. I was told repeatedly over the phone that there was no reason why our request shouldn’t be approved this time. On two different occasions, the person that I spoke with essentially told me that our case was a no-brainer, and pre-qualified us for the loan modification right then over the phone. To date, we have been “pre-qualified” by five different agents that we spoke with on the phone. This seems to be the company’s method for shutting customers up and gaining their trust.

On August 27th, we received a call from Kimberly at ASC to notify us that our request had been denied due to the fact that the negotiator had calculated a $5,000/month discrepancy between what we earned and what our monthly bills were. Upon further investigation, it appears that the negotiator double counted our income tax withholding, and completely disregarded the letter and proof that we had submitted showing our monthly expenses, choosing instead to go by the credit report that shows credit card payments that we no longer have and an extra mortgage payment.

We asked to speak with a supervisor, at which point she hemmed and hawed, and transferred us to the main number for Wells Fargo banking. We called back, and spoke to Ingrid, Kong, Martin, Christina, James and David, finally being told (after 2.5 hours) that the computer system was down and we would have to call back, at which point we were hung up on. Each time, we had asked to speak with a manager, and before being transferred, were told that we were being transferred to a manager. However, none of the people that we were transferred to were in any kind of supervisory role, and it was apparent that they were tired of talking to us and were simply trying to foist us off onto someone else.

I called the Loss Mitigation number back today, and finally was able to get the name of the last Negotiator who denied our application. It is Mr. Garcia-Long, and his supervisor’s name is Eleanor Connely. The man that I spoke with today put me on hold while he spoke to his supervisor about the problem, and then came back with the answer that his supervisor would contact Ms. Connely and ask her to contact me within 72 hours to address the denial of our application. I will be astounded if I hear back from Ms. Connely, but certainly hope that she will investigate this matter. In all of my several hundred hours spent on the phone with ASC, I have yet to manage to speak to a supervisor of any kind.

We believe, after dealing with ASC for the last seven months, that the company has no interest in allowing us to keep our home. Furthermore, we feel that we were deliberately mislead into believing that we would be approved for a loan modification when there was little to no possibility of this actually happening. If we had not been told repeatedly by ASC representatives not to pay our monthly mortgage payment while our loan modification request was being processed, there is no way that we would have fallen so far behind that we were unable to catch up on the payments, let alone falling far enough behind that ASC would be able to proceed with Foreclosure. We have used the money that we could have used for mortgage payments to pay down our credit card debt, upon the advice of ASC representatives. From everything that I have read about the company online, we are not the only family facing this scenario in which ASC makes it impossible to submit an application for Loan Modification that will be approved. We have been lied to and given the run-around for over half a year by our mortgage company, and are currently facing the loss of our home because we did exactly what representatives of ASC told us to do.

I started out to say here that I would also be sending this letter to ASC’s executives. However, upon searching the internet for ASC, it has become apparent that while “ASC” is a dba of Wells Fargo, it does not exist as a stand-alone company. The SEC has no record of America’s Servicing Company, and the only information that seems to be available through search engines are website after website dedicated to complaining and exposing the unethical, and in some cases illegal business practices of ASC.

Therefore, I am also sending this letter to the executives of Wells Fargo, as well as to Senator Jeff Merkley, Congressman David Wu, state representatives from my part of Oregon, and Oregon’s Attorney General.

All we want is to resume our monthly mortgage payments and to stay in our home, and ASC couldn’t care less whether or not they destroy our lives and evict our children from the only home that they have ever known. Please do anything in your power to help us.

I too have gone through the same thing posted by Amy. I followed Amy's lead and wrote to my US Senator, asking why Wells Fargo got to borrow 25 billion at zero interest, yet Wells Fargo dba ASC wants 9% from me? I fore warned ASC in December that by March I wouldn't be able to make full payments, due to the fact that my Christmas accounts canceled all or most of their parties (self employed bakery owner)- those parties saw us through the winter slow months. They paid no attention. I got a "Well I guess you have to sell your house"..sure at 100,000.00 less than I paid?
They also lost my paper work, had inaccurate figures, put me on hold, got told ''all I am is a telephone tech, I don't know what this letter you're referring to is about" (well sweetie, if you don't who does and can I speak with them?)...In the phantom letter it read, and I quote, " Please make sure to sign and ....." there was nothing written after the ''and''.
I called after resubmitting the paperwork for the 6th time and was told I was going into a forebearance account. If I make those payments, they'll consider a modification. PEOPLE LISTEN,,if you're not getting anywhere with the company, write to every single REPRESENTATIVE in your district, State and National. Including General Attory, Insurance and Banking..I have no idea whether or not this will be permenant or not..I'll keep all of you posted

ditos, to the lady who had the guts to put ou u tube, her blog against BOA, WELLS FARGO, CHASE AND SOME OTHERS. AND SIMPLY TOLD THEM WHERE TO GO. THAT YOU AND ME NEED TO GET OUR MONEY OUT OF BOA AND THESE BANKS TODAY. I see it as the ''powers that be'' want us to remain ''powerless'' and have us fight ''amungst ourselves'' over who's to blame. We are where we are, we can't go back--BUT WHAT THE HELL ARE WE GOING TO DO ABOUT IT. First, I started offering cash discounts at my store for people who do not use their cards...One way to hurt them. So do NOT take your eyes off the prize, don't let the media tell you it's all getting better..if all of us, and thousands like us are all having the same problem WE ARE NOT YET COUNTED in their ''statistics'' du jour. I think we ALL learned the hard way that creative bookeeping got us here. Henry is right , take your money OUT of large banks, put them in smaller neighborhood banks.
