Foreclosure with Wells Fargo has me on the brink of losing my home

January 14, 2008

Received Summons separately from the Court on 1/5/08, and I need help to respond to these summons before Jan. 25th. I have been in communication with Wells Fargo, but my feeling is that they want to proceed with foreclosure. I'm expecting a reasonable option but I feel they are losing time telling me different stories when I call. I submit the paperwork they asked, and yesterday they told me I have to submit them again because my signature was not dated. But I have been calling each week as they told me, and they didn't tell me this before. They told me they received the Hardship Letter, List of Payments and Expenses, Pay-stubs and 2006 Tax Report, and the case was in the hands of a Negotiator. Please I need your help do I don't want to lose the house in foreclosure. My last option is to sell the house.

Please if you can email me with your story. I am in the same boat. I will post how things started in just a second. I just received a notice myself and sent in 3 different packages for quote a loan modification...during that time all I did was worry an save money to have for a down payment that never came through. I have been checking with pro bono lawyers tonight in fact posting my story everywhere. If enough of us could get together maybe we could do something. Heres only part of my story the other half is basically about the same as what u posted here. My prayers are with you.

Wells Fargo is trying to STEAL my home. An are succeeding. With fraudulant business practices. It seems they have the power to overcome American business ethics.

Hello, I'm from Bossier City, Louisiana. I am currently on the verge of losing my home for a difference of $72.00. Yes, thats right $72.00.
I was on a repayment plan of $518.00/mth with Wells Fargo.
My plan started January 2007. I received a notice at that time in regards to my payment plan.
From that time on I never received anything from Wells Fargo. Nothing.
Then in April 2007, I received a monthly statement stating that I owed $492.00 for May, which I paid. Excited that my mortgage came down a few bucks. I am low-income an welcomed the extra cash.
In May, I received another monthly statement from Wells Fargo stating I owed $472.00 for June, I paid that.
In July, again a statement I owed $472.00. I paid that.
One week after I sent that payment in. I received a notice of default from Wells Fargo now I owed almost a thousand dollars.
Despite my efforts and hours of talking to them. They WOULD NOT except my payments even though it was a misunderstanding that I actually consider their fault. They told me I fell off the repayment plan and unless I could pay the full amount owed now there was nothing they could do. There was ABSOLUTELY nothing on my monthly statement in regards to the repayment or I would have quickly dismissed the amount and paid the $518.
Is this legal? If anyone would please email me at dlrfs@hotmail.com with suggestions of what I can do I would sincerely appreciate it.
Or if I am far fetched to think that this is improper business tactics I will not be upset to have someone tell me that.
Also, if anyone else out there has had the same thing happen to them in this way. I would love to hear from them.
Where I come from. An again I'm no business executive.
I always thought that business accounts were updated an showed proof of everything that was going on. Not just for the business itself...but for the customer as well. I understand that would be considered good customer service and essential business practice.
I don't understand how Wells Fargo can get away with literally forcing me out of my home for a difference of $72.00 that I was more than willing to pay. I am held completely at fault for following my monthly statement. At that time chaos was going on in my life and I thought those lowered payments was the one good thing happening to me. Little did I know it would lead to me losing my home.
