I have a buyer on my house, I need some time from ASC to let it sell

January 03, 2008

I am the owner and real estate agent and have had the house on the market since July 2007. We moved to another city in August, about 2 1/2 hours away. After several viewings of the home we have received our first offer on 12/22. We were served about a week prior to the offer. We are currently renting in the city that we are in and cannot pay for two residences. I have tried to get ASC to delay the hearing, reduce the legal fees so that we can close and not have to come out of pocket to close. I have a signed contract from the buyers and the closing is scheduled for 1/22/08. ASC has offered a repayment plan on 12/28 of $2800 by 1/3. Which of course we don't have. I have no credit cards and no one to borrow from. At this point it is easier to close on the property then to come up with the repayment plan. Our hearing is scheduled for 1/4/08. I just want ASC to postpone the hearing, bring us current and be paid off on 1/22/08. The buyers are pretty eager to get in the house and had I have received a pre-approval letter from their lender. What can I do?

My experience with ASC is that they will not work with you in any reasonable way. Postponing so that you can avoid foreclosure is the obvious best scenario even for ASC but they are not savvy enough to see that and will do whatever is easiest at the time. No negotiations regardless of the changes the government is trying to create to alleviate this crisis. It is next to impossible to work with ASC. Personally, I would love to find a lawyer who is brave enough to take on ASC and stick it to them as they have done to so many families.

I have two buyers for my home and I can't get a price from ASC for a payoff for my home at 118 Seamarge Circle in Pensacola, Florida 32507, my loan #110021429. I have not made a payment in 1 and 1/2 years, and all of a sudden I receive a letter to my home in new orleans that my payment has gone up, but they will not give any price to sell this home and end this mess. This company needs a more hands on approch so there customers can talk to a person and not there phone systems, as it stinks. Please help??????? Mr. Richard T. Carr

We too have had negative dealings w/ ASC. We fell victim to the poor market conditions, we bought another house to down-size & w/ hope thata the proceeds from the sale of our original home would pay off all credit card debt. Big mistake. We marketed our home & move to our smaller place-we continued paying to mortgages for 8 months,we realized we couldnt do it anymore. We lowered the asking price-still nothing. I contacted ASC to see what our options were-almost impossible to talk to a live person,then when you do, it better not be 1/2 hour prior to close, because they will just hang-up in mid conversation. I wrote them letters-no response. I finally got a form from them stating my options. I faxed it back to them rtequesting a deed-in-lieu & explained our circumstance. Again nothing. We then stopped paying-better believe they started calling then-explained to the CSR that we made attempts for help/resolution & recieved nothing-explained the situation to him & he put me on hold for 5 mins then hung up. Why? because it was 5:50 pm. I called back only to get the recording they were closed. After 3 months of non-payment we were served on christmas eve w/ a civil suit. We consulted a bankruptcy attorney-Select Legal-another big mistake-thats another forum. Anyways we have heard nothing else-we continued to pay the electric bill up until this past April,I then attempted to contact their attorney to tell them that I was having the electric taken out of my name & that they should contact the power co. to get restored. I have heard nothing & I know that it was sold for a lot less than its tax value. Soo sad-its sitting therre w/ weeds around it deteriorating, it was a good home. I tried to get help from them but my pleas fell on deaf ears. I'm sure they have something in store for us-probably wage garnishment.....
