Who can get a partial claim?

September 27, 2007

A partial claim is something that is offered through HUD. They will loan you the money to bring the loan current… you will have to pay all of the attorney fees upfront though. The only way that a partial claim can be approved is if you have been turned down for another plan by your mortgage company.

”I was working with the mortgage company for a modification but due to miscommunication I missed out on the modification. I would like to file a partial claim to bring the loan current. ”

If you receive a Partial Claim HUD will place a lien on your home for the amount of the loan. This will have to be paid off during the life of the loan. They do not put you on a payment plan. Please contact us if we can answer any further questions for you on this topic.

We have a conventional loan and paying $421/mo. PMI. We have gotten behind 4 mo. on our payments. Our house payment is $1421 with the PMI. We can now make this payment until we can refinance out of the PMI, but will we qualify for a partial claim to reinstate our loan?

I have an fha insured fixed rate mortgage with US Bank.US Bank told me to get 4 months behind before they could file for a partial claim on my loan and now they refuse to file for a partial claim. I am now over 6 months behind by trying to deal with them. I was told to talk to a credit counseling company so they could mediate. The credit counselor told me that in all her years ... she has never seen a bank file a partial claim. So why do we get told about this wonderful possible solution when it seems to be impossible to file for it?

i file for a partial claim sent in all the paper and a payment for latepayments and other stuff they the paperwork said my 1st house payment is may 1st so what i want to know is it finally all settled

I too have filed a partial claim sent all paper work in and my late payments as well, I have a log of all times and confirmations for all mailed items. My first payment is due may 1st and was told to make a payment on May 1st. My late payment certified check was mailed back to me twice and had to resend it, of course with a confirmation on delivery. I was told that it was because the paperwork was not in the system, so the check was rejected. Even though I sent it the first time will all my orderly paperwork. I addressed to the claim officer each time. I know they are over worked for this is tough times. But, I will tell you my assigned partial claims person is very rude, and never lets me finish my sentences. I never felt safe with him taking my case. I have left many messages to reach me on my cell phone (in which I sleep with) and on all paper work sent to him. Including the certified check sent both times. He just left a message on my home phone for me to call before 1pm,and he could of reached me on my cell phone instantly. Our home phone is only for the four adults (children) and my husband and I ,living in our home which gets checked every friday by someone in our house, so that messages will get to each person. That is why we give our cell phone numbers for very important call, just like this partial claim negotiator. Well if he would listen to my concerns and my comments maybe he would of read all the email I sent to him from the main office and all the notes, and messages given to him. I know what is being asked of me on the partial claims office, but this negotiator needs to take just a min out of his time and communicated with me better. So once again I have to try to communicate with this negotiator on Monday. So do I make my payment on May 1st, hopefully he will be able to give a straight answer

I have just been reading a few of the comments about the Partial claim. I am just about to get into my partial calim this month, I hope. I have had to make the 3 payments and than apply for the partial claim. I am afraid that I wont get it based on the emails I have been reading. I just watched a programe that showed a mant that had been forclosed on and had not made a payment for 1-1/2 years and still living in the house. We are trying to do what they want but seem to not help in the end when the itme comes. Keep fighting.
