I have tried to work with them, what else can I do?

Many people contact us completely frustrated with their mortgage company and make some a decision to file bankruptcy. Bankruptcy will help come home owners get back on track but as a whole it usually fails. We always council home owners to only file bankruptcy if that is there only option. In this case the mortgage company seemed to present no other options but usually there are. We can go to them and negotiate on your behalf. They don’t want you to file bankruptcy because it only delays things. They would rather get you in a plan and get you to making on-time payments again. Here is an example of someone who recently contacted us and is having some problems, filed bankruptcy and now is in real trouble.


”We were only making a partial payment to our mortgage company because our mortgage company told us to. They were working on a loan modification when our payment on our double wide trailer went from 519.00 to $848.00/mth.(This was a result of an ARM) Then our payment went to $1,121.00/mth., my wife called the representative who was handling our loan modification. She explained to her that we couldn't pay it, that this trailer is not worth that much. The loan officer told her not to worry keep paying the $848.00 payment until she can finish with the loan modification. That's what we did. Then, four months later the sheriff showed up at our home with sale papers to sell our home. I confronted my wife about it when she got home and she didn't know what it was about, so she called our loan rep.. But we were forwarded to a person who told us that the person who was handling our loan was let go from the company and if we wanted to stop the sale we needed to come up with about $4,500.00 in back payments and legal fees to stay in our home. My wife and I both tried to explain to her that we were told by our loan rep. to make the same payments we had been making. but she clearly didn’t care. We also asked her if we could make up the remainder of the payments that were behind until our loan rep. could be contacted. She told us that's not how it works. She maintained that we pay $4,500.00 to stay in our home. We told her we could pay the rest of the payments we were short but there’s no way we can come up with $4,500.00. We asked her if she could just talk to the loan rep. who was handling our loan modification but she wouldn't. We hung up the phone. We didn't know what to do from here other than to talk to a lawyer to find out what we could do to stop the sale. Well bankruptcy was the choice we were given and to this date the sale has already been stopped twice. The bankruptcy has been discharged and there’s no stopping the sale this time. Our attorney talked with someone at the mortgage company and they claim there is no file on any loan modification. Is there anything we can do that we haven't done already?

I AM FROM NY STATEOF NY AND AS OF FEB 1 2006 I HAD THE MONEY TO PAY OFF MY LOAN. ANY TIME I TRIED TO CALL THEM THEY WOULD NEVER RETURN MY PHONE CALLS I ALSO HAD A MIDIGATION CORP TRY THEM ALSO AND THEY NEVER RETURN THEIR PHONE CALLS. THEN A COUPLE OF WEEKS LATER WHILE THE MIDAGATION COMPANY WAS TRYING TO STOP MY FORECLOSURE I GOT PAPERS SAYING THAT MY HOUSE WAS SOLD. I NEVER GOT PAPERS HANDED OR MAILED TO ME SAYING IT WAS BEING SOLD AND I HAD THE FULL AMOUNT TO PAY OFF THE LOAN. ANYTHING I COULD DO NOW? PLEASE HELP ME WHEN MY ATTY TRIED TO GET IN TOUCH WITH THEM IT TOOK THEM 1 MONTH TO ANSWER HIM BACK AND THEY TOLD HIM " TO GO TO hELL" IN HIS WORDS THANK YOU

ANYTHING I COULD DO NOW? WHEN MY ATTY TRIED TO GET IN TOUCH WITH THM IT TOOK THEM 1 MONTH TO ANSWER HIS CALL AND THEY TOLD HIM "TO GO TO HEEL" IN HIS WORDS THANK YOU
