Wells Fargo mortgage issues

February 11, 2007

Indiana foreclosure

This is an actual comment from a client:

"The reason for default was the death of my husband 8/10/2006 and also I had right knee surgery Dec. 13, 2006 Yes it has been turned over to an attorney, the reinstatemnet amount is $2545.00, due by 02/15! I tried to bring my account current through Feb. 2007, on 01/26, and was told they they could not accept my payment because they had filed foreclosure on 01/23. Wells Fargo was notified in writing on 01/02 that my account would be brought current through 02/2007 on or before 02/01/2007. My first month behind was NOV 2006. Earnest Gibbs (supossedly the HEAD supervisor) said they received my check stubs on Nov. 26, 2006 to supposedly work out a payment plan, I NEVER heard a thing! When I called to check on the payment plan, I was told it would take 14 to 30 days to work on, so to be patient. I Have owned the home since July 2005, refinanced with Wells Fargo (BIG MISTAKE) in May 2006 The loan is a conventional Loan Interest rate is approx. 7.9% I do not understand how they can do this when I did everything they asked me to do!!! Thank You,"

medical hardships are perfect examples of the legitimate reason to fall behind in your mortgage payment and mortgage companies agree. The problem is getting through to the person who can make the decision for you at the mortgage company. We have relationships with all major mortgage companies to you right through them and get this resolved for you. Just because attorney has become involved does not mean we still can't get to work out for you. All it means is there will be additional fees incurred that will be added to your reinstatement quote.

We work with Wells Fargo on a regular basis and have an excellent relationship with them.

I was lead astray by a representative of Wells Fargo Home mortgage about a loan modification. I broke my back in Feb. 2007 causing me to fall behind on payments. I was set up on a repayment plan when a representative of Wells Fargo Home mortgage contacted me to discuss some options. In that initial conversation, I told the rep that I could feasibly borrow the money from my sister to catch the loan up, but I really did not want to do that (pride etc). The rep ran my financial and said that I was pre-approved for a loan mod. He gave me a new payment amount, the due date of the new payment, and all the info I would need to fax in. I faxed the required documents in and called to check on the status and was told that the documents were not received yet, but that the house had been placed in foreclosure. He told me to call back later that day to see if the docs were received. I called back at 5:45 pm that same day and was told that the docs. still were not there, but the home had been removed from foreclosure because there was a pending loan modification on the account. I continued to call back at least once a week for the next 3-1/2 months, each time asking if the mod had been approved and if the home was in or scheduled to go into foreclosure, each time I was told that there was no decision made yet and there was no foreclosure action being taken. On Dec. 10th 2007 I was reading the local paper and was shocked to see that my home was in foreclosure...I received no notification, no letters, nothing and still had no answer on the mod. At this point it had been 4 months since I had completed my portion of the modification so I started a flurry of phone calls which resulted in finally getting an answer on the mod...no. I was offered a repayment plan that would include all the fees accrued from the attny and late fees. The initial payment was $4532.95 which I sent that day. The mortgaeg company proceeded to hold that money in suspense for over a week and continued to charge me attorney fees. I have a payment due of $847.49 on 1/16/08 and a payment of 699.00 on 2/16/08 then the loan will be current. My question is, can I recoup some of the legal fees since it was Wells Fargo who contacted me about this modification, they took so long, and they voided their own policies by putting the home into foreclosure, then removing it on the same day because a modification was pending (they clearly state that all collection and foreclosure proceedings will continue) also, every time I spoke to a rep I was told the home was not in danger of foreclosure, so I thought it was safe? I have sent two letters to the conflict resolution department of WFHM and have yet to have an answer!

I have been having trouble with WF on my mortgage trying to have them apply payments to my account and they continue to give me the runaround. Long story. But I am in New York and would like to sue Wells Fargo because I have been struggling with them since 2006 and things still are not resolved. Please forward the attorney that can win for me. Your help is appreciated. This is urgent

We have been trying for over a year to get a loan modification thru Wells Fargo Mortgage. Due to a layoff & loss of 40% income. We keep getting the same runaround asking for the same paperwork over & over that they already confirmed was received.
How do I enter the class action against them.

As soon as I applied for HAMP via phone, Wachovia DID NOT ALLOW ME YO MAKE MORTGAGE PAYMENTS, repeatedly stating (by several of their drones) that ..,. (we do not accept ANY payments while in the modification process". Then Wells said I was in default & started foreclosure.
I am physically disabled Native American female on SSD (struck by a drunk while in a squad car at work as a first responder & civil servant) & not mobile & live in PERMANENT CHRONIC PAIN & I was diagnosed with a terminal illness & not suppose to be under stress (impossible when dealing with world savings-wachovia-well Fargo.) Need Help!
