I have the money to catch up... why won't they take it

February 27, 2007

Colorado foreclosure

This is an actual comment for a client:

”I have the money to catch up the payments but cant find who will take the payments. I want to keep my home.

Can you believe that some people actually have a hard time finding someone to take the money? Unfortunately it's not only true that happens quite frequently in the mortgage industry. Once you get behind on your mortgage payment the mortgage companies have a set of rules they need to go buy to once again take payment. Technically if they accept a payment from you they cannot foreclose and therefore they want to make sure what the situation is before they will accept any money. We can easily complete this transaction for you and stop the foreclosure.

This is the first year in our home.
The taxes say july 2997 to june 2008. I though I had until June to pay them. Just got a letter about a tax sale in May. I called to see if I could put the i/2 year taxes in the principle and start an escrow account.

My son has special needs and the tuition is $1OOO A MONTH AND ONE DAUGHTER IN NURSING SCHOOL. COULD YOU PLEASE HELP ME PAY THIS ONE TIME. I HAVE CALLED AND THEY SAID NO. WHY EVERY OTHER BANK WILL HELP YOU.

I had a lot of medical problems last year and made about $10,000 less than regular, so I got behind on my house payments. I am trying to get Citi Mortgage to lower my payments, but they keep putting me off. I need help to keep from losing my house. I have lived there for 26 years.

I just spoke (June 9) with a man named Christian in the Executive Response Team, extension no. 52816. He was very short-tempered and rude to me. After all that I have been through, with all of the conversations I have had day after day after day, with the frustration and bureaucracy that Citimortgage offered me, along with the stupid accounting mistakes and lack of attention to my situation, I spoke with a RUDE employee.
Again I was told that it will take at least 3 days for the corrections to take effect.

He agreed and saw that there was a messy accounting mistake on Citimortgage's account, but was nonetheless rude and dissrespectful to me.

In February. 2009 I applied for a Workable Solution - citimortgage's homeowner assistance program.

As part of the process I was put on the forbearance plan, and told that at the end of the three months of payment I should contact Citimortgage again to become qualified for a Workable solution.

- Hide quoted text -
Prior to being in the Homeowner Assistance plan my mortgage account was perfectly up-to-date, I never had a late payment.

In the plan I paid
2/27/2009 $877
4/6/2009 $877
5/6/2009 $877

The end of May I called to make a regular June payment of $1095.03

At that time I was also informed that I would not qualify for the Workable Solution program.

The shocking thing was that after all of the application materials I sent in, and all of the bureaucracy I went through, and with all of the mess in my account, IT BOILED DOWN TO A SIMPLE MATH DECISION. Citimortgage simply took my gross monthly salary, and then looked at my monthly house payment, and because the monthly payment is below 31%, I was denied assistance.

Isn't assistance supposed to be about extenuating circumstances? That is why I applied. Why didn't ANYONE TELL ME THAT IT WAS THE 31% FORMULA AT THE VERY BEGINNING? I COULD HAVE SAVE MYSELF A LOT OF GRIEF.

Now I needed to make up the difference of those three months of $654.

In addition I discovered that Citimortgage had also put 3 months of late charges on my account, $41 each month, plus a delinquent fee of $30. I NEEDED ASSISTANCE AND Citimortgage WENT AND CHARGED ME, RANDOMLY FOR APPLYING FOR ASSISTANCE.

I set up a repayment arrangement for the $654. as well as regular mortgage payments on May 29.

I received a notice in the mail for the repayment plan - THESE WERE NOT THE DATES, NOR THE AMOUNTS, THAT WERE SET UP ON THE TELEPHONE WITH WHOMEVER I SPOKE WITH THAT DAY ON MAY 29, 2009 - THE PAYMENTS WERE SET UP TO COINCIDE WITH WITH MY PAYCHECKS - WHAT I RECEIVED IN THE MAIL DID NOT REFLECT THE CONVERSATION OF MAY 29. 2009

This is the plan that I received in the mail
$1200 which I paid on 5/29/2009 (check by phone)
$1216.88 due on 6/29/2009
$1216.88 Due on 7/29/2009
$1216.88 due on 8/29/2009
$1216.88 due on 9/29/2009
$1216.88 due on 10/20/2009
$1216.88 due on 11/29/2009

When I tried to make a debit card payment on May 29, 2009, Citimortgage rejected my card, even though I had more than $7000 in that account on that date. Citimortgage took a check by phone payment of $1200, and waived the $10.00 check by phone fee.

I was nervous about making future payments - a Citimortgage agent dissuaded me from mailing my payments in because Citi could not guarantee that my payments would ever be POSTED on time (IMAGINE THE NERVE!). Because my debit card had been rejected I feared paying by telephone every month with an addition $10 fee for check by phone. I did not want to be charged $10 every month for the next 6 months to make a payment by check.

And I was nervous about actually being able to call and reach Citimortgage - the TELEPHONE ON HOLD TIME WITH CITIMORTGAGE MAKES IT IMPOSSIBLE TO CARRY OUT BUSINESS WITH THEM.

I HAVE A FULL-TIME JOB TO TAKE CARE OF. I HAVE BEEN ON THE PHONE ALMOST EVERY DAY SINCE MAY 29, 2009. I AM PUT ON HOLD FOR CRAZY AMOUNTS OF TIME. WHEN I AM TRANSFERRED THE CALLS ARE DROPPED AND THEN I HAVE TO START OVER AGAIN EXPLAINING THE SITUATION TO A NEW AGENT. I AM NOT ALLOWED TO SPEAK TO AN AGENT I HAD SPOKEN TO PREVIOUSLY - CITIMORTGAGE HAS NO MEANS FOR DOING THAT !

On May 30, 2009 I asked to cancel the repayment plan and wanted to just plain catch up with the payments.
On May 30, 2009 I made a payment of $372.20 by debit card (THE ONE THAT WAS REJECTED ON MAY 29!!!!!) and thought that I was caught up

On 6/5/2009 I discovered that I was still not caught up and made another debit card payment of $177.00

Today, June 8 I have discovered again that I am not caught up. The funds have not been applied correctly have been on the phone already for 2 hours today . And it still is not solved

THE INSANE PART OF THIS IS THAT I HAD A PERFECT PAYMENT RECORD. AND DUE TO CITIMORTGAGE'S ACCOUNTING ERRORS, OMISSIONS, BUREAUCRACY, TERRIBLE CUSTOMER SERVICE, LACK OF TRANSPARENCY, I AM IN A TERRIBLE MESS.

MY ACCOUNT REALLY IS CAUGHT UP.

HELP ME!
WHAT DO I A WANT?
CITIMORTGAGE HAS MADE A MESS WITH THE ACCOUNTING OF THE FUNDS RECEIVED, NOT APPLIED THE PAYMENTS CORRECTLY, AND YET I AM SHOWING AS NOT UP-DO-DATE. I WANT CITIMORTGAGE TO CORRECT THIS MESS!
I WANT CITIMORTGAGE TO REMOVE ALL LATE AND DELINQUENT FEES.
I NEED a workable solution- I AM A RESPONSBLE MORTGAGE PAYER - REDUCE MY INTEREST RATE. APPARENTLY BECAUSE I HAVE NOT BEEN IRRESPONSIBLE I DO NOT QUALIFY FOR ASSISTANCE
