I have the full amount to catch up... they won't take it

February 25, 2007

New Hampshire foreclosure

This is an actual comment for a client:

”CALLED ASC AND THEY STATED THAT I MUST PAY $5,761.00 BY MARCH 5, 2007 TO BRING ACCOUNT CURRENT OR THEY WILL START FORECLOSE. I HAVE THE MONEY TOGETHER AND WANT TO PAY THEM PRIOR TO MARCH 5TH. THEY HAVE REFUSED PRIOR PAYMENTS MADE IN JANUARY DUE TO I AM NOT ON A REPAYMENT PLAN AND COULD NOT QUALIFY. I WILL BE PAYING THE LOAN CURENT ON MARCH 5TH VIA A CREDIT CARD. AFTER I PAY THIS LOAN CURRENT BY MARCH 5, 2007, WILL THEY STOP FORECLOSURE PROCEEDINGS. THAT IS WHY THEY ARE NOT ACCEPTING PAYMENTS ACCORDING TO THEIR CUST SVC REPS. WHAT A WAY TO DO BUSINESS AND GET YOUR HOME TAKEN AWAY FROM YOU!!! PLEASE ADVISE”

It is unfortunate that some people actually have a hard time getting the mortgage company to accept full reinstatement. The problem here could be multiple reasons. One of the reasons we ran into in similar situations is the person has the full amount to catch loan up but they don't have the attorney's fees. Other situations would be where they just can't get a hold of the right person to make a decision and take their money.
We can definitely get this worked out for you. Please call us for a free consultation.

my client owes 193000 to american servicing company ( the 1st lien holder ) home is worth 185000 to 190000 ,2nd lien is 52000 to bank of america i have a signed purchase and sales agreement for 190000 also have a commitment letter from buyers bank, i sent all this twice to loss mitigation at asc plus 5 faxes, voice mails, etc offered asc 155000 to approve short sale of property .client will also owe 3000 in city tax 13000 or so tax stamps, legal, and commissions . asc sent me one letter saying they received my request for short sale now after 3 months they will not respond to me by email ,fax, phone, mail, nothing at all no one has foreclosed , buyers are getting impatient , sellers have not made a payment in six months to either bank what can i do to close this sale ?? do i have any options ?? what can i say or do to get asc to respond or agree or any counter offers from them?? i would really appreciate an immediate reply from you why is asc being so non cooperative??? my deal is better than a foreclosure sale i believe. thanks again george also bank of america said they would not sign off loan for 1000 or 2000 also said my 22000 offer to them is too low.

I have been trying to work with ASC
on getting my payments caught up and I show that I am only one month behind but they are showing that we owe almost 5,000. I have sent them faxes and asked numerous
times and I get no response from them.
I have given them my email addressand my cell #.
I tried to call again today and
now they have us in foreclosure and
are not taking my calls.
I can prove that I am only one month behind and I can pay 2 payments to get me caught up but
they refused my payment.
Please advise.

ASC is the most dishonest company I have ever had to deal with. If there is any way possible to get out of this mortgage RUN!!!!!! They told us they would work out a repayment plan for us we called for three months only to hear that they were working on it and told us not to make a payment "It will only be returned". That is what we heard 100 times it seems. My husband ended up in Bankruptcy court and now they are giving our Lawyer a hard time. I pray that someone will put them out of business.
