Can they repossess a manufactured home?

North Carolina foreclosure

This is an actual comment for a client:


”I am not working at this time. I left my job due to illness and tried to go back upon recovery, but was forced to find a lesser paying job that I will not began until March 26,2007. My wife is working and has been for a little over a year, but could not afford to make the payments. Our home which is a manufactured double-wide 80' on a brick foundation is in my name and my brother’s name. I would like to get the home in my name and my wife’s name and get the payments lowered. My credit is not good, but really what looks bad was for good purpose. We tried to eliminate some of our more expensive bills to be able to afford our home, partly because we have family, but none that we can live with, but before we could get started we had lost out to this. Our first hearing is on Feb. 28. and from there I don't know where we will go. Please can you help? ”


This is a very tricky situation because the loan is not in your name. The mortgage company will not work with you unless you are on the mortgage. We will have to have your brother sign the paperwork to allow us to negotiate with the Litton. Once we have that authorization we can go to them and arrange a settlement to allow you to begin to make your payments again.

This brings up another important point. A lot of people don't know understand how a foreclosure works on a manufactured home. If the home mortgage is tied to the land then the normal foreclosure will take place. If the home is not tied to the land then there will be no foreclosure and they can repossess the home similarly to an automobile. If this is the case in your situation there is no negotiations do can be done and they can't come one day and repossess the home from you. We have a mobile home that someone has bought it from us, however, we still hold the note and he pays us.
How can i get this note out of our name and into his?

I am currently 2 months behind on my house payment. The next payment being due on Oct.1. The mortgage co said if I Could'nt make payment on Sept 24th, they would start foreclosure. Can this happen if I'm not 3 months behind. They know I have a child that has healith problems and has 24 hour care. What can I Do?

I have a 12yr old mobile home that I bought new.
Due to unforeseen circumstances I have fallen behind on payments.
However, I did just pay $500, which is a amount over the normal monthly payment.
I was told by the morgage company that they were keeping my $500 and still foreclosing.
Can they do this? I have a small child and a handicapped Mother.

I am in Oregon. Green Tree is the lender on My mother's Manufactured
home in a park. She died. I have been making the payments. I am behind
2 months. They have been OK with this until now. Last month they threatened me with eviction because my name is not on loan. Loan is still in my Mother's name.
How long does this "eviction" process take if I don't pay them this month? Please , someone who knows answer me. Thanks.

I HAVE A MANUFATURED HOME IN FL, OF WHICH I HAVE BEEN TRYING TO SELL, iT IS IN A SENIOR PARK,I AM PUTTING OUT $500.00 A month FOR THIS SO I am thinking of letting the home go back, how soon can they reposess it,
