Why won't they take my mortgage payment?

December 05, 2007

Wanted to make payments late, but they would not let me unless I came up with more than one at a time.

This is what happened to me. I was told that I was behind a payment and next thing I knew my house was in default and going into foreclosure.

I am too having these problems. Most of our money went into the principal or equity instead of our monthly payments. Although we send them more and more we are still in default. I asked to adjust the payments they put into the principal and equity but they can't do anything for us after 30 days. The thing with this is we never knew where our money went and finally we got our bank involved. At least we know now where the money is but according to them we still need to pay more. This is really discouraging and I do feel that we are forced into foreclosure

I was going to pay them a partial payment and the rest before the grace period ended, they said no. I then couldn't come up with two payments total and lo and behold = DEFAULT. I have not paid a payment now since January 2008, it is October 2008 and they haven't even sent me a foreclosure date. I sent them an offer for short sale, they haven't even called me back. Before that, they told me I was eligible for a Deed in Lieu of Foreclosure = 25 days later found out that was untrue. These customer service reps and loss mitigation reps are completely rude! I call them almost every day re: my short sale offer and they call me about 3 times per day using the automated system, after I sent them a letter stating communication should be made in writing. Go figure! I want them out of my hair.

I was finally able to speak to a real person=) They reamitorized (sp?) our mortgage, even sent someone to us to get papers notorized. Everything is fixed now at a lower interest rate 6.5% AND it's a FIXED rate=) BUT for the same amount we bought our house to being with. Oh well such as life-

I have electronically paid Saxon Mortgage $6,836.58 in two payments since 4 December 2008. Saxon has both accepted the payments and given me confirmation numbers from the payments. I also received communication from Western Union "Speedpay" confirming he payment. Saxon to this date, 17 December 2008, has 1. Not acknowledged my payments. 2. Has sent me a half dozen "Pre-Acceleration Warnings", one of these by registered mail. 2. Told me, via a supervisor that "Saxon had "returned your(my) money." This is an outright lie. There has been (a.) no electronic deposit back into my checking account (I confirmed this with my bank - SunTrust); (b.) There has been no registered or certified mail containing a refund check; (c.) There has been no first class mail containing a refund check.; (d.) There has been no money order or cashier's check for any refund.
Saxon Mortgage Services has outright lied blatantly to me and harrassed me continually with threats of foreclosure. In addition: I have paid into an "escrow account" with every payment to include payment of my property taxes and PROPERTY INSURANCE. Yesterday I received a letter from Saxon that I had not shown proof of fire insurance on my property and that they were going to insure me and charge me over $2,800 for a Saxon purchased policy. I called my insurance Company, Virginia Farm Bureau Insurance, who in turn called Saxon to tell them that (1) my homeowner's insurance is and has been all along current. They also told me that Saxon had not paid them since 2007 although I had been paying Saxon for the insurance all of 2008. Who got my insurance money to use all that time?
Saxon continues to harass me both by letter and phone and will not acknowledge receiving my payments paid this December. What have they done with my money?? I fully intend to file fraud charges and charges of violation of Federal Lending statutes. - Sincerely, Raymond G. Woolfe, Jr.
