Should I give my house back to them?
December 13, 2007
I lost my job 07/01/07 and have been applying but unable to find a new job. I have liquidated my savings and more to pay mortgage. Adjustable Rate goes up soon, and no jobs are in site for me. I just made the last payment I can, I have no more $. I also have a car lease and credit card bills. Do I need to get out of this loan and or give up my house?

TO SHORTEN STORY -ADVISED I MUST MISS 3 PAYMENT IN 9/09.DEFAULTED 12/29/10,RECEIVED 18 NOTICES OF DEFAULT.MID FEB/10. I CALLED WACHOVIA WHO CLAIM NO DOCS IN FILE, NOTHING. REDID INTERVIEW, I&E, AFFIDAVIT, EVERTHING. NEVER TOLD HOUSE AUTION SET FOR MARCH & ALL MAIL FROM WACHOVIA WAS SENT TO AN INCORRECT MAILING ADDRESS, AND BY REGULAR MAIL. NEVER CERTIFIED,SIG REQUIRED OR FED-EXD DURING ENTIRE PROCESS.
i CONTINUE BI-WEEKLY CALLS AND FAXING ADDITTONAL DOCS IN ADDITTION TO REPEATED MISSING DOCS. ANOTHER PHONE INTERVIEW REPEATED IN APRIL W/HOSTIL WACHOVIA REP,SHE FAXES MY ANOTHER AFFIDAVITS AND MORE REQUIRED DOC TO FILL OUT BECAUSE THEY'RE "MISSING", MADE CALL 5/25, SAME PROBLEMS,REP PROMISED TO FIX TOLD HE WOULD PERSONALLY BRING FILE TO SUPERIORS,CALL HIM BACK ON 5/27. NEW REP VERY HOSTILE AND NOTIFYS ME HOUSE AUTION ON 6/11.BECOMES ANGRY WITH ME BECAUSE I STILL DONT HAVE JOB,"WHAT'S WRONG WITH YOU...ANYBODY CAN GET WORK IN THAT TIME".CRYING I BEG HIM TO STOP AUCTION.HE REFUSES,ALSO REFUSE TO ACCEPT ANY MORE DOCS AND STATES HE PERSONALLY WILL BRING MY FILE TO LON MOAD COMMITTEE. I BEG HIM FORHELP/ADVICE,HE SAYS HE CANT ADVISE ME AND HANGUP. I IMMEADIATELY LIST HOUSE FOR SHORT SALE W/AGENT,WACHOVIA APPROVES IN 3 DAYS,GET SUBMIT 2 OFFERS. NO ANSWERS BACK. NEVER TOLD OF IMPENDING AUTION. ON 7/14/10 RECIEVED CALL FROM REALTOR THAT HOUSE AUCTIONED TWO DAYS PRIOR 7/12.
7/16 NOTICE OF EVITION NAILED TO DOOR. SERVER SUMMITS DAY OF SERVICE INCORRECT. ALL MAIL AND NOTICES SENT TO WRONG ADDRESS CAUSING UP TO TEN DAY DELAY IN MY RECEIVING.CALLS TO WACHOVIA NOW CHANGE DEPTS AND DEALT WITH MANAGEMENT,AS I TRY TO REVERSE SALE TO THEMSELVES BEFORE DEED RECORDED. AND TO STOP ANY POSSIBLE EVICTIONS. aLL THREE MANAGERS STATE THEY NOTICE INCONSISTANCIES,AND VOW TO IMMEADIATELY INVESTIGATE AND AGREE TO STAMP/NOTE/RED LIST "NOT TO EVICT".ALL OVER FILE TO PREVENT FURTHER MISTAKES. DEED RECORDED PUBLICLY BY 7/24. ALSO BEGAN CALLING PROP.MANAGEMENT TO TRY CASHH FOR KEYS, RE-LEASE ECT. THESE CALLS ALWAYS WITH SAME GUY, KNOWS NOTHING, BUT AGREES TO NEGOTIATE. THESE TALKS CONTIUED UP TO 10/28/2010 (7/19/2010)
RECEIVED LETTERS 7/29 IN SAME ENVELOP. STATEING SHORT SALE DENIED W/ NO REASON AND LOAN MOD WAS DENIED AND TO LEAVE NOW SOLD HOUSE. tOLD TO DEAL WITH LAWERS AT RTS(REGIONAL TRUST SERVICE)
- NEVER ALLOWED OPTIONS TO PAY PAST DUE BEFORE/TO STOP SALE EVEN THOUGH I HAD ENOUGH MONEY IN BANKS AND INVESTMETICE TO EVICT/UNLAWFUL DETAIER COMPLAINTS FILED 8/19 AND RECIVED 8/29/10.VIA NAILING TO FRONT DOOR.
SENT LETTERS, VOICE MAIL &EMAILS TO LAW FIRM FOR WACHOVIA & WELLS(WELLS REPS CALLED WEEKLY SINCE DEFAULT TELLING TRIED TO SIGN ME IN LOAN MOD AND SHORT SALE W/THEM.WACHOVIA TOLD ME TO CALL D.A. &POLICE) TO TO THEIR LAWYERS AS DIRECTED IN NOTICE. IN ONLY ACTUAL DISCUSSION W/FIRM SEPT 1, 2010, TO TOP OR NEGOTIATE UD LAWYER JUST REPEATED I MUST ANSWER UD WW/IN 5 DAYS AND COULDNT ANSWWER QUESTIONS ABOUT MY RESPONSE. CONFIRMED RECEIPT OF MY LETTERS AND NOTED THAT iM A DISABLED PERSON,UNEPLOYEED, AND BROKE. SAID HEWOULD ASK WELLS FOR OPTIONS. GAVE HIM CORRECT MAILING ADDRESS HE THEN CONFIRMED ALL CONTACT INFO. NEVER HEARD FROM AGAIN

CALLS,ETC FOR ANY EXPLANTATION TO LAWFIRM, GO UNRETURNED. --NOTICE OF COURT DATE,10/12 RECEIVED 10/13 - DEFAULT JUDGEMENT FOR NOT APPEARING RECEIVED 10/29/2010 WITH SHERRIF NOTICE BY NAIL TO DOOR, AFTER 6:00PM -LAWFIRM REFUSES DISCUSS SAYS TO GET OUT LAUGHINGLY. PROP MANAGER REMEMBERS TALKING BUT NO NOTES,WONT ACT TO STOP OR POST PONE SHERRIF, SAYS ONLY WELLS FARGO CAN MAKE DECISSION, AND THEN -REFUSES TO GIVE ME ANY NAMES, NUMBERS OR EMAILS OF ANYONE AT WELLS AND REFUSES TO GIVE HIS LAST NAME, LAWYER STATES HE'LL SUBMIT STAY OF EVICTION REQUEST WITH DIRECTION ORTEND ORDERS ON FRIDAY 10/29/2010 I ATTEMP EX PARTE APPLICATION,IN PERSON AT COURT DIRECTED ON SUPERIOR COURT SITE WITH EXPARTE APPLICATIONLLO NOTIFIED OPPOSING LAWYER VIA VOICEMAIL AT 9:00PM THUURS.10/28 OF MY IMPENDING FILING.
GET TO CLERK BUT THEYCLOSE EARLY DUE TO BUDGET. TRY TO PRESENT CASE TO JUDGE BUT DOES NOT STOP STAY, SAYS IM IN WRONG COURTROOM AND REFUSES TO PROVIDE DIRECTION OR HELP. THEN LECTURES ME ON MY FILING (WRONG FORMAT(COUNTY DOESNT HAVE FORM TEMPLATE) AND I SHOULD GOES TO COURT LIBRARY.TO BRUSH UP ON MOTIONS. MAKES NO DECISSION. SAID MAY ATTEMPT AGAIN,BUT SHE WONT MAKE RULING OR STOP EVICTION BECAUSE NOT CORRECT COURT.
