PHH will not accept the partial payments

December 21, 2007

I was making partial payments ($401 per week) and PHH was not applying the payments the hold them and send them back 5-6 weeks later.

PHH hold my checks of full payments and then take me to foreclosure. pay all but $41.00 of my home owners payment, try to foreclose because i have no HO insurance. subtract 3 property tax payments, that they only pay one of and then charge me $1,200 +dollars escrow instead of fixing their incorrect paper work

PHH TRIES TO MAKE PROPERTY OWNERS THAT ARE NOT IN A FLOOD ZONE PURCHASE FLOOD INSURANCE, AND IF YOU DONT THEY INCREASE YOUR MORTGAGE EVEN THOUGH YOU HAVE DOCUMENTATION TO PROVE IT!!!

Mortgage company PHH.... my payment double because of a error in taxes assessment amount. I worked on getting my account corrected from Sept 2008 up until today March 2009. This has been very stressful for me most rep do not speak english. When I reach someone who would listen/understand he advisd me to request for my escrow to be reanalized. All information was faxed Jan 2009. My payment was corrected as of April 2009 in the mean time I had to make payment that was double my mortgage or I would have went in to forclosure.

PHH is foreclosing on my home. im just sick over it. they sent notice to the court the first day after payment was due to get my protection lifted. last year i had to pay and extra 500 a month on my mortgage to keep them happy. that went on for 6 mos.
im to the point... ive had enough of them. my bankruptcy attorney said if they foreclose, i walk away once it is lifted out of my bankruptcy. but from what ive been reading, these people really deface you on your credit to the point you may never recover.with as many houses in foreclosure do they really want one just sitting around waiting to be bought or what ever? why dont they work more with the people during all this. everyone is in financial distress......

PHH just lost a major law suit in NY, where the judge ruled in the homeowners see NY Times 'If Lenders say"The Dog ate your Mortgage" 10/25/2009.
The fact is that in all probability your loan has been sliced and diced so many times into MBS, Mortgage Backed Securities, that they can not produce in a court of law the original loan document, which more and more judges are demanding as proof.

The lawyer that won this case is David B. Shaev out of NY, he has a web site which is worth looking at.
There are many more consumer advocate lawyers around the country that are winning cases for clients with this effort. It worth a look to hire a good one.

In the end it is a high probability the PHH does not even own your mortgage!Therefore they can not legally foreclose!

Well for the 5th year in a row PHH held my August payment, cashed my september sat on my October payment, sent a foreclosure to my lawyer and then chashed my checks one at a time after the letter was sent out and my lawyer is rediculas saying it all comes out in the end when I don't have the money to start with. Even the lawyers are not intouch with what the economy is doing to us all......

For the past year 1 1/2 I've been going though hardship just like alot of America people.PHH Mortgage have been my BIGEST problem! We as home owners need to band together & put some fire under PHH to make them be more helpful in trying to save families homes.For months I sent them payments & they said that they didn't receive them, I confirmed the address several times.They still reported it to their lawyer as if the account was default. Then we as customers end up out of more money trying to save our home.

I was laid off in Nov. of 08 and just recently started a job. We maintained our mortgage payment every month,, until two incidents occurred. One, my unemployment was held for the month of November in '09(not received) and a crooked lawyer(now in Federal Prison) caused a legal issue having our personal bank account depleted of $3000 in August of '09. I have called since being laid off to work some kind of plan, as well as since being employed. They told me at first I don't make enough to go on repayment...REALLY??? I had not noticed(sarcasm). Then I was told two different times I "qualified" for Two DIFFERENT programs. When I asked why they were so different, I was told "maybe you did not disclose the same information". To which I said I did not appreciate being called a liar...of course she said that is not what she meant...RIGHT!! And I am so VERY tired of speaking to people who do not even work in the US. The communication is very difficult. I know because I asked. They are actually in India. Since I just started back to work after a year and a half, how do they think I can catch up completely in 2 months??

OK!! now I have heard it all!! I post friday and get home to a letter that has a check I mailed them on March 1, 2010. With a letter attached saying I owe them $4,161.56 and that the check is being returned. I call and ask what they are up to now. A very nice young man answered, spoke english and pulled up my account. Listen up...There is $1066.and change in a suspense account if I release it and send them $1918.18 my account is ok...? my question if they would not keep putting money in a suspense account and apply it to my mortgage as they are supposed to put my payment of $1,004.75 I owe them $918.18 for this month...how are they taking me to forclosure when $918.18 is all I owe them if they would just stop trying so hard to foreclose on properties??? I do believe a class action suit is deffinately in the works..from homeowners insurance payed not the amount billed, and my insurance being cancelled-here comes the forclosure letter in 2008. Then forclosing for lack of funds when they showed they paid my property taxes 3 times in October of 2008, and I show up with the payment from the township to dispute them but company policy is I still pay them and they'll work it out later. To holding my checks saying I didn't send them and when I get the canceled check they are stamped with the day they recieve them -August 21 is the stamped date on the check and in October they are foreclosing for not recieving-send the letter on Oct.21 cash checks Oct 26th. But again I'm in foreclosure and in court fighting...I then have to pay for their lawyers and mine...WHERE IS THE JUSTICE OF ANY OF THIS PHH IS A SHADY COMPANY THAT HAS RUINED MY CREDIT MORE THEN IT SHOULD BE AND THEY ARE CROOKS...I WOULD RATHER OWE THE SO CALLED MAFIA.

PHH mortgage forclosed on my house on july 9th 2009, on july 29,2009 they resold my house to a texas mortgage based company. my house was onteh cover of parade magazine in 2006 along side of a texas house. coincidently the mortgage company that bought the mortgage from PHH was the texas based company. PHH is also receiveing money to help prevent people from loosing their homes in case people didnt know. they are receiving money from the bailout.... and yet they double standard under the pretense of helping. they are in with the H.O.M.E here in the richmond virginia area. they are supposed to help people from loosing their homes,,,,, who is bailing who out here.... and how many other false pretense of names are these people under?

PHH is such a joke of a company. My husband is Active Duty Air Force and we were forced to move from our WA home, not by choice, in May 09. When we received our military non-voluntary orders I immediately let them know the house was going on the market and that I wasn't sure how long we would be able to keep making mortgage payments since we were moving to Key West and base housing would take all of our housing allowance. So we put our house on the market, moved to Key West, living on base where the base community department (Balfour Beatty) takes all of my husbands $2600.00 to pay for our dinky base house. This was once the money we used to pay for our mortgage payment. Needless to say we fell behind, fought with PHH to push through a short sale in October 09 which was lost due to their neglect in processing our paperwork, they kept "losing everything" and we lost the offer. Long story short about a month and a half ago we got a call from a company called Cedant who supposedly works short sales in conjuction with PHH. We told the lady the offer was dropped due to PHH's neglect but she still agreed to work with us anyhow. So we had to send in more information to her and are still waiting for someone to buy our house. Well the funny thing is this. A few weeks ago, we received a payment coupon book in the mail from USAA who we originally went through for our mortgage, it was for our same mortgage amount and said payment was due 06/01/2010. I figured they had seen our new financial information, seen that we were somewhat back on our feet and wanted to give us a chance to pay on the house. WRONG!! I called the Mortgage Service Center, spoke to Lindsey who very abruptly told me they would not be accepting a single payment from me. I'm confused...why send me a payment coupon book if you're not going to accept a payment from me?? Well needless to say they want the full amount due or nothing and NOTHING is exactly what they are going to get. I can not believe a company that does business like this still is able to function. WOW!! I am completely awwed at the failure of our system to protect homeowners.

YES PHH IS AND ARE CROOKS WITH A LICENS TO STEAL..FURTHER MORE THEY WILL WORK IT OUT IN THEIR FAVOR, LOOSE ANYTHING THEY CAN AND BLAME IT ON INCOMPETENCE-BUT IT WILL ALWAYS BE THE CONSUMERS FALT...THE WORST OF IT ALL IS THEY GOT BAIL OUT MONEY FROM OBOMA TO HELP PEOPLE THAT ARE STRUGELING AND THEY JUST PUT THE CONSUMER FURTHER AND FURTHER INTO DEPT.

WHAT I AM NOT UNDERSTANDING IS THAT WHY HASNT THE BETTER BUSINESS BUREAU HAVE DONE SOMETHING ABOUT THIS OR SOMEONE WITH SOME KIND OF AUTHORITY TO NOT LET THIS HAPPEN TO SO SO MANY PEOPLE AND ITS SO AMAZING HOW EVERYONE ON HERE HAS OR HAD THE EXACT SAME PROBLEM AND NO ONE CAN SEEM TO HELP US AND WE FEEL HELPLESS IF SOMEONE COULD GIVE SOME KIND OF ADVICE TO STOP PHH MRTG FROM DOING THIS I WOULD LOVE TO HEAR IT BECAUSE I SURE THE HECK DO NOT HAVE MONEY FOR A LAWYER TO TRY AND SUE THEM SOMETHING NEEDS TO REALLY BE DONE ASAP!!!!!!

They are foreclosing on our home for the very same reasons: Held payments, "didnt receive paperwork", etc. We have the back payments and late fees but now it's to an atty and that added $4000 more than the $1900 we owe.
