Can we get them to take the reinstatement amout to stop the foreclosure?
On Dec. 2006 mortgage was acquired by Ocwen from Indy Mac. In Dec. 2006 payment went "missing" at exact month of transfer. We wrote to Ocwen with little positive response. We continued to make payments till July when our accounts did not balance at our bank. Ocwen continued to apply payments to previous month and added late charges to existing statements. In May/June/July 2007, we believe our bank accounts were attacked from a computer based scam or identity theft or possible mail theft that exposed our bank accounts - we did not know what was happening for a number of months to our bank accounts. In November,( as soon as we had some information what was causing our accounts to go crazy ) we wrote to Ocwen to inform them of this problem and received no word from them, instead we starting hearing from an attorney for Ocwen. We wrote to Ocwen ( November ) to ask for an amount to bring the account current and in good standing, we would send in certified funds on December 15th- again - no response from Ocwen, but a letter from their attorney ( Dec. 14th ) informing us of the foreclosure date. We have all necessary funds ( we believe - not knowing legal fees, etc. ) to bring account to current status. We have tried to research the laws in New Hampshire applicable to " Re-Instatement of mortgage" and cannot understand if Ocwen is required to allow us to bring account current if possible. We believe we are "upside-down" on the value vs. loan amount in this real estate market. We want to keep our home in Greenfield and we have a Jan. 10, 2008 Foreclosure date looming over us.
