Can anyone help with ASC?

December 14, 2007

I am trying to get some direction in dealing with Americas Servicing Corp. I have been working with them on a loan modification and have submitted documents repeatedly. I even have paid a loan modification fee, after pre-approval, in September and was told that I would be called by someone in the loss & litigation area. I was also told that my modification would be in place by 12/1/07. I have received no communications except someone else’s letter. I was sent someone else loan payment plan, which consisted of 3 payments and 1 large $16,000 payment. This was addressed to someone else but had a cover sheet with my name. I am getting nowhere with ACS, but I am fearful of the next steps. I am on the verge of filing bankruptcy to force them to do something.

I have a 1st and 2nd mortgage with this company. The 1st is at 8% and the 2nd at 11 or 12%. As part of my loan modification, I requested that the two be combined at the lower rate. Obviously our housing market in Florida has dropped drastically. There are 100’s of houses up for sale in our neighbor and some have been for over 1 year. We could not even sell the house to pay the loan value. I am lost as to what to do. I am going to file a complaint with the local BBB, but I am sure they are flooded with these types of complaints. Thanks for any direction or suggestion that you can provide.

Our mortgage was sold to ASC after a re-fi we took out with Pinnacle. Our contract was sold too ASC without our knowledge accept a single piece of paper from ASC. We didn't even know who to send our mortgage payment too. We called ASC to find out and they didn't even have us in the system.Six months later we get a notice stating that our taxes were not payed and our house was on the chopping block. We called and found out that ASC states that our previous lender was not taking out enough equity. We called ASC and they stated that they would take care of it. Then we get a call saying that we owe them money to pay for our insurance. They raised our mortgage payment by $400.00 to accommodate the lost. After a need of career change we are unable to pay the high mortgage and asked for help with ASC. They said that since we were not in foreclosure that they could not help. What? Do they want to foreclose on our house to get the message that the need to get their act together and realize their customers situation?

My husband and I have fallen behind three payments on our home. We fell behind because, my husband's job had a expectant slow down period in August 2007. On November 1, 2007 we sent ASC a hardship letter requesting a loan modification. This would make it possible for the delinquent amounts to be put at the back of our loan. Which would give us a new start. Now it is Jan. 2007 and they tell us that our loan is still being reviewed by the negotiators. As of now our loan is in foreclosure. I am hoping that they will modify our loan. This is a very stressful situation.

I have my loan in foreclosure with ASC as well. They will not work with their customers. I was one month behind and tried to get mortgage modification - they said no, I don't qualify - they filed for foreclosure before they even otld me I don't qualify. They will foreclose rather than taking a deed in lieu. I am trying to get a short sale with them now, but they are dragging that out. I have not received any statements from them in a couple of months either. They more than doubled my mortgage payments to more than 1800 Dollars - I started with 932!
Anyways, there is no help for us out there so I am giving up.

There is hope! ASC approved our loan. This has been in the making since 10/07 and I thank God that he worked with our very helpful negotiator in making this happen for us. For those that are going through the same situation. Please continue to be try hard and stay on them. I promise it will work out! With persistence and not giving up, it was approved. KEEP TRYING!!!

I am also a customer (not a lawyer) of America's Servicing Center (aka ASC) and have been reading on numerous message boards about the same situations over and over with customers of ASC. Such as Incorrect information given, misplaced payments, false information, lies and downright fraud.

Here is an update of my situation. they have now refused the offer the buyer made. They are going through with the foreclosure. I never received anything regarding a court date etc. The buyer was told the property is up for sheriff sale May 8.
ASC ordered a company to break into the house in January to "winterize". In the process they broke the front door. Can they do that when they don't officially own it yet? Also, I had storm damage at the house which prevented anyone from living there, so I took out my 401K to fix the damage. I had the insurance adjuster out and they paid the amount of the receipts I was able to show them, but the repair was not finished becuase I ran out of money first. Well, they said they would not pay anymore until I could show receipts, but they send the insurnace check to the mortgage company. So, not only does ASC keep insurance money, but they also prevent me from finishing any repairs. They royally screwed me, so like I said before......I give up.

I would like some feed back on ASC. They gave us paperwork in Oct 2007 to do a loan modification. We finished the plan in Feb 2008 and have been waiting ever since for the modification... well, I found out today that it was denied.... NOW WHAT? Can I talk to anyone else... our negotiator is worthless. The one we began with does not return my phone calls so I don't know if he even works there. The one who is doing it now says there is NOTHING she can do? PLEASE... WE NEED SOME HELP!

I'm trying to get a since of whether ASC is engaged in a particular fraudulent scheme to inflate revenues. If anyone has attempted to make online payments on the due date or just before that only to discover that the service was temporarily "unavailable", I'd like to hear about it.

Didn't the president sign something saying they have to help us. The first time I called they said there was a sell date of Aug 20, 2008; now they say there is no sell date and we are behind 5 months - that doesn't sound right. They told us not to send any money and they would review our case and it will take 60 days. I am afraid in 60 days somebody else will own the house. HELP is there anybody who can do ANYTHING. These people must be working from HELL

The modification issue has become a political football more than a legitimate effort to assist home owners. First, most of the problems a result when the original loan is no longer being serviced by the originator. If you financed the loan with one bank and later received a notice that your loan is now being serviced by someone else, that entity does not have the same incentive to help you. It does not own the loan. It is merely processing payments and receives its profit from fees associated with servicing the account (e.g., late fees). So, when someone runs into trouble, the servicers pretend to be overburdened and take their time helping (if at all); much of the time they will not even talk to homeowners until they have misses payments and, thereby, generated significant penalties for the servicer. The resulting modification--in many cases--will ultimately be more harmful than the original situation.

Here's what you do. If the servicer is not answering your inquiries or otherwise delaying for months, make sure you quietly document everything. Send letters rather than making phone calls. Keep copies. When you do talk, get names (not likely given) or Identification numbers of every person you talk to. Write them down. Do not let them intimidate you and do not let it become argumentative. Just record the events. Note every department that you speak to. Then, take some time to write your entire experience down including the information that you have collected and send it to your state attorney general's consumer complaints division.

The answer to your question Alex is simple. Politics. Take it from me, I'm an attorney who sues major banks for consumer fraud. I just finished with a very successful settlement on behalf of a class of several hundred thousand people against one of the largest banks in the country re: fraudulent credit schemes.

The current regime (Bush Adminstration) practices top-down economics that was the hallmark of the Reagan administration (a/k/a trickle down theory). Pursuant to this theory, government should always support and even subsidize the creation of wealth in the business sector. The idea that Reagan had was based on--albeit naively so--belief in the benevolent, trustworthy businessman. If the theory had worked, the benefits bestowed on businesses would be passed down to consumers through job creation and employer based health care and rising salaries, etc.

The problem was with its premise of the benevolence of businessmen in America. There is no such thing. Businesses are driven by the ever increasing need to increase investor wealth. Giving good salaries, pensions, heal care and other benefits does not exactly allow for the fastest revenue growth. The same is true for the banking industry's lending practices. Giving everyone prime rates and conventional mortgages is not in keeping with the goal--albeit corrupt--of increasing profit margins at all cost.

So, that said, currently we have a government wedded to big business. The 700 billion bailout is, so far, just that. Until the next president, do not expect to see any of that money passed directly to struggling homeowners (where it is most neede and where it will do the most overall good for the economy).

What's the net of this? I'm not going to tell you who to vote for. I'll say only this, do your research about the economic policies of each candidate. Don't be a fool to believe that the plans outlined will be exactly or even close to what is actually implemented. Your main concern should be the candidates' "guiding philosophy and beliefs about economic policies" and how they translate into help for you. While the plans may change, the goals do not.

If the goal is to help businesses first, you come last and only if the business community chooses to give. And, how has that approach worked so far? If the goal is to help the consumer, then you can expect radical changes in consumer protections and how incentives and rewards are distributed so that they insure that banks and businesses in general do right by the American consumer before the get anything. So, go out and vote.

This all sounds very familiar to me. I, too, fell behind about three months due to a difficult pregnancy and birth. Since then, I've been back to work, full time, and able to make my payements again. ASC has no interest in getting me caught up. They play games where you fax them something, and they lose it. You all and speak, at length, to someone, and they don't note it in your file. They don't return phone calls or even pretend to know what you're talking about.

They finally sent me a letter saying that I had agreed to some payment plan that I've never heard of before where I would make three monthly payments for SLIGHTLY less than is my normal payment, and then on the fourth month, I would give them a HUGE amount of money to be caught up. Where does this magical money come from, you may ask? Well, i sure don't know.

If I HAD that kind of money, I wouldn't BE behind, now would I?

We were thinking of just short selling the house and forgetting the whole thing, but now I'm reading all your horror stories about that!

If there is an attorney out there willing to take us on, a class action suit sounds like a wonderful idea.

Let's hope our new president is true to his word and makes these greedy fools do what they should have been doing all along.

My husband and I both work in the automotive industry. As you all know the industry isn't doing so well. We've cashed out all of our savings, 401K's, sold as much personal property and borrowed from everyone we know in order to scrape together enough money just to survive (sound familiar to anyone?). To say the least, we're financially out of options. As a result, we're finding it increasingly difficult to continue making our mortgage payments. Although, we haven't missed or been late on any payments (yet)we're trying to avoid it and ultimately avoid foreclosure. We've tried to call ASC a few times but have yet to receive a phone call back. Having read all the comments and blogs regarding seeking help and any assistance from ASC I'm a little worried about how ASC will treat me, who like so many of you, is a loyal and paying customer who has fallen on hard times. Sounds like I need to prepare for a very intense fight. Any opinions on what steps I should take and what to expect?

A really good resource for anyone out there is to contact your congress person. (You can find out who your congress representative is online). They should have a list of places who are non-profit that help out people in your situation to deal with your mortgage company. Also, there are supposed to be some programs being put into place to help out with all the foreclosures and such.

I will say that a lot of times, unfortunately, unless you are IN foreclosure, they are often hesitant to talk to you.. so.. that's what I know for whatever it's worth. :)

I've read some of the comments and we fall into some kind of black hole. Our loan was sold/given to ASC, we aren't behind yet but, would like to modify the loan for a fixed, possibly even at lower fixed rate. When I called about this modification service (which is offered on the website) they said our deficit is greater than $1000. and once we got our expenses under $1000. to call them back. If that's the case then we wouldn't need to call them! So, now I've gone to an organization called NHS (neighborhood housing services)and we're letting them mediate for us. Wish us luck!

I am lost...this is the hardest thing I have had to deal with. Yes we can...no we cant... You qualify... you don't. All I want is to follow the instructions and comply. If i am asked to jump I will, but when I am asked to jump and than appologized because I jumped to high or to low, it is way old. I have a family of 5 and I will protect them at all costs. including protecting them from the Giant gorilla we know as ASC. If you are not able to hadle the programs than find someone who can...but do not drag us through fecal matter when I feel the fool for getting myself in this mess with ASC in the first place.

I hated dealing with ASC, who suddenly was servicing my mortgage after about 18 months of making payments to a different company.

ASC lied to me about my state raising my real estate taxes and requested an additional $300 per month to make up for the difference between my tax escrow and the new tax rate. I called my state government and confirmed that my tax rate had not gone up at all. When I confronted ASC with this piece of information, they told me to fax them proof from the state. I obtained the proof, and faxed it to the number ASC had given me, but they continued to deny receipt of my faxes and continued to bill me the extra $300 per month. It was a lot of money to me - my original monthly payment was only $700, so it was a huge increase. I actually went into forbearance for a bit, because I had so much trouble coming up with the new monthly amount.

Eventually I got a lawyer to send the fax for me, and ASC dropped my monthly payments back to the original amount.

I got tired of getting the run-around and decided to hire someone to fight for us!
We were only one month behind on our adjustable rate payment when I tried to get ASC to modify our loan and all they did was give me the run-around! I couldn’t believe it when the guy on the phone (he was a big jerk!) actually said that my family shouldn’t eat so much because then we would spend less on groceries and would have more money to make our mortgage payment! He also said we should get a cheaper car and a bunch of other stuff that was really rude. This whole thing was keeping me up at night worrying about what was going to happen to us. I told my friend at work about this and she said I should call the loan modification company that got her loan modified down to 3.25% fixed interest rate! I finally decided to call them, and in about 45 days they got my interest rate down to 3.85% on a fixed rate too! The company is American Foreclosure Specialists and we are really happy with what they did for us. The website is afscanhelp.com. We chose them because they didn’t make a bunch of promises like some of the other companies and they had a 100% money back guarantee. I hope this helps some other people fighting with their loan company!

After reading the comments posted I know that my husband and I are not alone. But keep in mind that a company like this will NOT be able to stand much longer. They have been exposed!!!! Help is coming soon! Just hold on and watch.

I uncovered the evidence of the scam ASC/Wells Fargo were committing and showed such evidence to the Wall Street Journal. Interestingly enough 2 days later I got a phone call from the Presidents office of Wells Fargo. They now modify ASC and Wells Fargo) any mortgage I send to them for modification. And not lowering by $200.00.
