Bankruptcy did not help me

December 07, 2007

I filed bankrupt in June 2007, thought payment plan was going as agreed -- until I received court notice from mortgage company (re: October 24 - hearing to be relieved).

I FILED BANKRUPT OCTOBER 2006, THINKING THIS WOULD HELP SAVE OUR HOME. I AM NOT THE TYPE OF PERSON TO REFINANCE OVER AND OVER AND/OR RE MORTGAGE, I FIGURED I'D STAY LOYAL TO THIS COMPANY. BIG MISTAKE!! I NOW, ON TOP OF MY PAYMENT INCREASE HAVE A BAKNRUPTCY PAYMENTS THAT IS HIGHER THAN SOME MORTGAGE PAYMENTS. I WANTED TO PAY DOWN MY DEBT AND GET CAUGHT UP, THIS IS RUINING MY CREDIT, HOME AND LIFE!!!
THANKS ASC. I WILL EVENTUALLY GET RID OF YOU FOR GOOD!!!!

I am in a chapter 13. I did a loan mod with ASC in August to keep my home. The payment they told me I would have turned out to be $325.00 higher than I planned or signed my documents for. Now I am in default.

1. So if I get evicted am I exempt from any debt with ASC.
2. Does anyone live in Virginia and knows what the eviction process is?

3. Is ASC owned or part of freddie mac or fanni mae......could i get some type of bail out help?

my house is set for sale on march 3, 2009 after foreclosure procedures, if i declare bankcrupcy now, chapter 7, will that stop the foreclosure? and for how long, thanks

Last year we were renting a home that went into default we tryed saving the home we were living in. so we started a short sale this asc denied the shortsale stating we could afford both morgages with a rate increase. these people are mad over 6,500 a month in morgages payments alone, in the result of this i have since lost both our homes and now am forced to file bankrupcy. thanks for nothing they say they will help they just lie.

I have not heard from them in a long time i am still waiting for a response from them.They wanted $8,000 in 1 month.all they say is that i am in review.That they did not recive the hardship letter and the financial worksheet after i have faxed it numerous times.I dont know how they can lay thier heads at night to sleep after lieing all day.God will judge them all.

All I can say is that everything that has happened to you has also happened to me.From the not recieving the paperwork to asking for thousands of dollars within days.WE NEED TO DO SOMETHING, IF ANYONE WANTS TO PETITION. I'LL SIGN. WE NEED TO LET CONGRESS KNOW THAT WHAT IS BEING DONE IS NOT WORKING.

Is there any protection for investment property?

My bank did loan renewals and refinances on four rental houses I own and for the last 5 years did not give me copies at closing. Don't tell me I should have demanded copies, I did. I complained to the State Finance Inst. and the bank file foreclosure on all 4 houses. I have $90,000 but the bank won't take any of it. They want to foreclose to get rid of me. I was not behind in my payments.
Are there any laws protecting investors in my situation? Please help. 9/1/09
