ASC is being verf difficult, what can I do?

December 17, 2007

I have called and called ASC numerous times to get them to work out a payment program. They tell me things like the computer is down call back tomorrow. I call back and I get another excuse and when I have asked if they have record of my last call yesterday they tell me I never called. I was served with papers 12/10/07 and even though they received my payment of $2000.00 on 12/07/07 that would have caught me up in my payments. They told me because of the notice they would be sending back the $2000.00 I have yet to see that money back. I was told on the 12/11/07 by one Rep. that they were holding the money in suspense while we would see if we qualify for a repayment program. The next day I get a call from the foreclosure trustee stating that ASC was sending the money back because they (the trustee) couldn't start the foreclosure proceedings when I had just caught up my payments? I called on the 12/12/07 I was told indeed that the money was being sent back to me and that I could fax in all my monthly expenses to see if I qualified for their program. I was called by the Trustee on the 13th and they stated that to stop the judgment that I could pay $9600 on Dec.26th that would bring my account current and pay the attorney's fees. ASC has lost payments that I have made and told me that I couldn't make partial payments they only except full payments above my total monthly payment. They wouldn't work with me on finding the supposed lost payments. I have faxed in copies of my bank statements . Ever since ASC bought our contract from Mortgage Lenders Network it has been a living nightmare. I am 2 months behind on my payments according to my bank statements. But with the supposed return of my Dec. payment that makes me 3 months behind. How can they legally state I am 90 days delinquent when I'm not?

I was sold to ASC two years ago, with a 2,175.00 mortg, my husband passed away last November and I asked ASC to work with me, but they said I was $200 short a month to help me, I am also two pymts behind, Nov and Dec ASC stated they would not delay in foreclosing on me, I've been in my home for 17 years and because of predatory lending and ASC not working with families to help them stay in their homes, I and my two children will loose everything we've known and my husbands legacy to have us have a home and be secure. Not to mention what else it will do to a single mothers credit. What can I do? HI MY NAME IS ALICIA THE MORTGAGE IS MY HUSBAND NAME MY HUSBAND LOST IS JOB AND ON HIS NEW JOB HE IS EARNING LESS SO WE CALLED ASC TO TRY IF THEY CAN WORK WITH US TO LOWER THE PAYMENT AND THEY SAY THEY CURRENT DO ANYTHING OUR PAYMENT IS FOR $2400 AND SEE I HAVE ANOTHER PAYMENT OF $835.OO SO TOTAL IS LI $3200 HUNDRED PLEASE IS THERE SOMETHING WE CAN DO SO WE DONT LOUSE OUR HOME.

i am under ASC mortgage i called them a few months ago asking them if i can make a payment but in a lower monthly payments since i am not making enough payments because our hours are cut off due to low censes they told me ok but my monthly payment went up to 4500 the more i cannot afford to make payments i tried sending half of what is so suppose to be my monthly payments but they return i t back to me now i am in the process off foreclosure what shall i do. i don't have a place to go including my kids and i don't want my house to go in fore closure can you please tell me what to do

**** ASC!!!! This is the worst mortgage company to deal with. They don't care about anyone or any circumstance. I hope the choke on my home and $300 debt... I am out!

ASC has been a nightmare for me too. They bought my loan and since then they have:
1) Screwed up the data entry so that they rejected my insurance carriers bill. (7 calls and numerous faxes to fix)
2) They screwed up the data entry so that they were not escrowing for my taxes and I got a notice from the County about being 2 bills behind and $300 in penalties. (3 calls and 2 faxes and I hope it is now fixed).
3) I just got another letter from them saying they do not have complete owner's information.
I am writing my congressman and the chairman of Wells Fargo.

ASC bought my mortgage 11/1/05 - my 12/05 real estate taxes were not paid and a tax lien was placed on my property. ASC Customer Service would not give me the real estate tax department's phone number so I am forced to communicate via fax. Their answer to my faxes was to pay the 12/05 r.e. tax and then charge me a escrow shortage - so I'm actually paying that $2800 real estate tax twice. I'm not giving up because clearly they should have already taken this from my escrow or have negotiated this with the purchase of my mortgage. Anyone know what government agency I can contact with a complaint?

ASC is by far the worst mortgage service company on the planet. The customer service reps are so poorly trained that there is no point in calling this company yourself. I have been calling this company for 6 months and have not been able to get anywhere with this company. If you have a second mortgage with this company don't worry about paying this them. Second mortgage do not foreclose 99% of the time for several reasons. Primarily the reason is taht they would have to buy out the first lien holder in a foreclosure and then try and recoupe there investment on the open market. There is not a servicer on the planet that will foreclose in this market today. The other one percent are people who actually have equity in there homes... if you have equity in your home... over 50k you will get dialed up in a foreclosure proceeding. In order to save your property in this case you will need to file a ch.13 and draw up your own terms to deal with the lenders and you can pretty much do what you want in a repayment plan to the lender. What needs to happen is for a class action law suit to filed against this company. That is the only way for this company to change and actually service our loans.

This company by war is the absolute worst to deal with. They were forced on me also and have had nothing but trouble. They could care less about working with you. They are the very definition of predatory.

It's true this company has done pretty much everthing that was stated on this blog, they are the reason why where in a recession. the government needs to step & shut them down. So on-slaught doesn't have to continue.

I am in the same boat as some of the people listed in this blog. I say what we need to do is contact our state representatives, contact local media groups to let people know what is going on. We also need to contact the Better Business Bureau and an attorney.

In these hard times we need to stick together, to stop this, not only for ourselves, but for others in the future.

AMERICAN SERVICING COMPANY IS THE WORST COMPANY I'VE EVER SEEN. ALL OTHER BANKS ARE WORKING WITH THE HOMEOWNERS BY GIVING THEM AN INTEREST RATE OF 4% INCLUDING THEIR TAXES & INSURANCE. MY PAYMENTS WAS $1747.78 I'M TRYING TO A LOAN MODIFICATION THEY NOT WILLING TO DO IT. INSTEAD THEY TOLD ME MY NEW PAYMENTS WOULD BE $3400.00 DOWN AND 3 PAYMENTS OF $2178.00 THEN THEY WILL REVIEW THE FILE TO SEE IF I'M QUALIFIED FOR A LOAN MODIFICATION WHICH IS A TOTAL LIE. DO ANYONE KNOW THE NUMBER WE CAN CALL FOR HELP LEGALLY. NUMBER TO THE COMMISSIONER? STATE ATTORNEYS ?? PLEASE HELP

ASC simply is the worst service provider on the planet. I have provided them with copies of my insurance and they are still charging me for forced insurance... I hope the government steps in to deal with these people. The only effective way to deal with ASC is to hire an attorney or file a BK. Contacting your attorney general Senator or writing the Wells Fargo president will not do any good. You can't do a thing against a company this big... they will slow roll you on answers until you are foreclosed on. The best way to fight ASC is through litigation.. don't waste your time trying to deal with them on a personal basis.

Nothing... it will be on your credit for 7-10 years. You can hire a credit service to clean up your credit report but it can be expensive and some things are very difficult to remove.

I have a question, ASC holds my second mortgage of $55k. I have been out of work since June 2008 and we are behind 4 months payments. I have worked with my first mortgage and they lowered my payment but ASC wants to raise my payments for 4 months and then review the loan (just like evryone else) So my question is do I let them start a foreclosure? My house is close to $100k upside down so they wont see a dime. Thanks for your help

While your credit will remain to be shot... ASC will not foreclose on your second... ASC which is wells fargo have ~85 billion in second mortgages that are worth 5 cents on the dollar... ASC would have to buy out your first in order to foreclose on you and they are in no position to be shelling out any cash at this time. Eventually your second will be charged off and sent to collection. However...they don't seem to be doing that either.. that is what I have read but dont worry about paying them right now.. just take care of your first and settle the debt with you second a couple years down the road. :) good luck

ASC bought out our first and they foreclosed on the whole amount. I was offered a loan modification in May 2007, after I had already moved out. I never received paperwork and I had already been evicted from the property. I kept calling them to tell them I would accept a loan modification but I did not know what my new payment would be. The condo we lived in is still vacant, would they be willing to do a loan modification now?
