Foreclosure madness…

Georgia foreclosure

This an actual request from a client

“2 yr interest only loan ended in May, interest rate increased 200.00/mth. Made July payment in August, have a repayment agreement set up with Ocwen. I am currently 45 days late on my second Mtg with ASC. They have been unwilling to let me make a partial payment, and have demanded that I pay the full two months payment in 5 days. I also have 2 month balances on all of my other utility bills and insurance premiums, and have made a month payment on my car to the end of the loan. I purchased the house as a new home, and am not sure if I can even sell it, as other properties in this area have not been selling. I don’t believe there is a way out for me. I have attempted to refinance, but quite frankly can’t afford the 30 yr interest rate and subsequent payments. I don’t have the best credit, however, most everything is over 5 yrs old now, except for the recent issues with my mortgages.

I have a 30yr fixed mortgage with a payment of 3355. I am having problems with the payment as I am on a fixed income of 1835.My home is a 3 family with 2 apartments rented, however one of my tenants moved a left me with An apartment that needs a lot of repairs, which I am still working on. I am paying 2000.mo for the mortgage. I have been able to make the payments until now but I know that effective June I will not have the money to pay the additional amt I called my lender and they said that because I only receive a pension. I need to get a job so that the can consider a full covered loan. Please help me!

It sounds like you have your hands full... unfortunately there is not much we can do to help you. If you can't afford the payments there is not much a Mortgage Company can do either.

Some things to consider... Do you have a local Church that might be able to assist you temporarily. If you could get the apartment fixed it sounds like you may be able to get it rented and back on track. Try and exhaust your local avenues for help.

I have a mortgage with Ocwen, I am currently up to date but can't keep it that way, I spoke with them and they are sending me info on a Deed/Lien program, do you know anything about this program, and if it will have a negative affect on my credit?

This program will wreck your credit. A better option is to try and short sell the home first.

We are way behind. My mortgage is rising as it as adjustable rate. Can you help and how? Plus my mortgage is too high - I'm upside down in the house.

I have been a Customer of Chase Home Finance for 3 years now. They Purchased my loan from New Century Mortgage after my 1st year in my home. Every payment I have sent in has been mailed 2 weeks before they were due, and every one has been held 20+ days before they even attempt to deposit them. This has made every payment LATE, so they can charge more interest and more late fees. THIS IS NOT FAIR!! It’s not my fault they can’t process my payments on time. Today I received a FORECLOSURE LETTER!! And I also received my check dated 8-25-2007 for my September payment that they held until 10-22-2007. Are these people Crazy?? I have been given over 11 phone numbers to use to contact people that only have Voice-Mail, and NEVER return my calls. Not even the Foreclosure Department has returned my calls. I guess they need a write-off or something, maybe that’s why they are determined to take this house back. Anyone with information on Chase Home Finance please contact me here.
I am starting a Class-Action Lawsuit starting TODAY!! ANYONE interested in being added please send me an email and I will forward the information on how you can contact the Attorney whom has TAKEN THE CASE.
Damage Resulting
This has ruined my credit due to them not posting my payments as they should, and I have had to Stop-Payment on my last 2 house payments because they are still floating around somewhere. They say they have not been received. They want me to pay it over the phone, except now they want all past-due payments "That they have screwed up" plus another $1500 in attorney fees, plus another $1700 in more BS Charges.

I have great credit and had a 2 yr fixed loan with Ocwen. I received my first rate change letter today increasing my mortgage $1000.00 more than what I pay now. I called Ocwen and they said they were sending me a package to go through and fill out a financial affidavit. I can not make the new payment it's is impossible. What are these forms about and this financial affidavit. My loan was originally what they call stated income, so do I have to show income now. And what will they offer me so I do not go into foreclosure

I recently filed a Ch 7 and have fallen 2-mos behind on my first, second and HELC. I did not sign a reaffirmation on any of these loans. Will the banks talk to me about a modification or should I consider letting go of my properly?
