What is a Hardship Letter

August 25, 2006

A Hardship letter is something most Mortgage Companies will require to consider you for a “Work Out”. This is your opportunity to appeal to them to give you anther chance. This should not be used to complain to what they have done or not done to make your situation worse. This letter must be honest and represent the facts clearly. It must prove to them that the situation that caused you to fall behind was temporary and you are now in a position to make your payments on time. You must also have a legitimate excuse for falling behind… financial problems in itself would not be an adequate excuse. Loss of a job, death in the family or an illness would be an acceptable reason to fall behind on your Mortgage temporarily. We have many examples of letters that the Mortgage Company is looking for. Remember... the hardship letter is only one piece of the workout. You still need to prove many other things to the Mortgage Company before they will approve you for a Loan Modificationor a Repayment Plan . Please contact us for a free consultation of your case.

I am sorry Gary, we don't have a hardship letter for your specific case. I think you can adapt one of our examples to work in your situation.

My husband had a judgment filed against him that prohibits him from operating his construction business or face jail time.

That definitely would qualify for a legitimate hardship. Unfortunately we can't do anything about the judgment. For you to get a workout approved with the lender you will have to show that you have enough income to afford the house. If you can't then the chances of getting a workout approved are very slim no matter what the hardship is.

Urgent...I am self employed and work slowed down for a while, i had two employees i had to get rid of i was loosing jobs because of there actions on the job. They didn't want to work. Work is picking back up now. My husband and I bought a home were we were stationed. My husband is in the Military. We purchased it in 2005 and it took one year to build, so the mortgage began in 2006. In 2007, my husband was re-stationed to NJ. We tried to sell the house but could not. We rented it to another military family, until we could figure out what to do. In the meanwhile, we had to purchase a one level home in NJ, due to the fact that my father had a debilitating stroke. We are helping to take care of my parents and are now faced with having the 1st home without renters when the lease is up in July. Is there any way we can be granted a deed in lieu of foreclosure? We don't want our credit to be ruined or our current house to be affected. Once the renter's leave, we will not be able to pay the mortgage.

I initially took out a mortgage loan at 7%, withing two yrs. it has gone up to 10%...which is now making it difficult to stay on top of - although I have only been late with one pym't - I am looking to modify the pymt's - hopefully back to the original pym't. After speaking to the mortgage co. - they requested several documents including a hardship letter which I am unsure as to what to include in same. Any help or suggestions would be appreciated. Need a hardship for my lenders. Have a 1st & 2nd Mtg . We are current thru April. $394, is what we owe. Can't afford the mtg. mts. We have contacted our Lender,they requested that we fax them a Hardship Letter. We suggested a short sale. They said maybe they can modify instead. Our total mtg pmt. is $2968.20 + 115.42 assoc. fee. R total monthly income is $3345.24. Can you help

We both work for the post office 10+ years. Cost of living going up and no overtime offered and days being cut short with less and less work is making it very difficult. Do you need to be behind on the mortgage payments to have a loan modified? I have a thirty year fixed loan, however, since we got this loan my wife and I had another baby and she had to change jobs (not making the same amount of money... and having another child doesn't help either). We are current on our payments. But at this rate we will soon fall behind. Our loan is with Chase. Any advise?

I have a house that I used to live in but due to tough ecomonic times I decided to go back to school. The house is now rented and I have a scholarship that pays all my school expenses. I would like the lender to accept the rent or lock in my rate on option arm. The current rent covers the negative am payment. What are my options?
